USCIS Giving Priority to Permanent Resident I-130 petitioners??

Otherwaise don't envy the F2A guys or the faster processing presently, IR/CR is one hundred times better. Maybe those days it's little bit faster on F2A,

but still it is like every month you are afraid of the visa bulletin and regression.rose.gif

It is really wrost feeling I ever had in life.

I get it. Like I said, everyone wants to be with their spouse.

Do you know how many exceptions of the rule (re: I-130/CR-1) happened recently?

One.

We (I-130/CR-1 filers )are afraid every month and every day, too. We, Overland Parker's were sent to a place that isn't even open yet. We don't even know when they will be open...

I know it;s hard for everyone, though...

Hard not to be envious, sometimes. (But still happy for that couple, at the same time.)

I miss my husband so much it hurts. And I'm not the only one... Breaks my heart.

6/21/2013 -Married in Stockholm, Sweden 4/16/2014- Case received at NVC

9/6/2013 -Priority Date 5/13 /2014- Case number and IIN assigned

3/31/2014 -Approved 5/21/2014- AOS fee invoiced and paid

5/22/2014- AOS package overnighted to NVC

Makes sense,

Although, my best friend's LPR husband submitted a petition for her (a few years back) (she's a German citizen) and it also took about 3 years.

Seeing 19 days F2A approvals is still just disconcerting.

You need to understand there is about a trillion US citizens applying for their spouses. And.. they have to wait longer than those applying for F2As. Or K-1s.

It's just the unfairness of it ..

Especially for us, OverlandParker's. We don't even know when they will become fully operational.

Talk about uncertainty...

That is a different issue. If you think your case is talking time to process you need to contact your congressman/woman/Senator. They can help you if your case is at USCIS/NVC. For F2A even if I-130 gets approved, it can sit there at NVC and no politician can help or do anything because NVC won't even touch the case if visa bulletin is not current which is not the problem in your case. LPR's are scrutinized even more because spouse of a LPR is not an immediate relative where as spouse of US citizen is one.

I would love to see statistical data that basically shows that US citizens had to wait really for a long time to get their K-1's, IR1/CR1, K-3 than a F2A holder. I don't think that is the case since spouse is an IR and that is the whole purpose of it.

Second, US citizen can bring their fiance on a Visa, spouse on a visa. Nothing like that exists for spouse of LPR. Until their interview at the consulate gets approved, they cannot visit U.S on either a visitor visa or even come and study here on a student Visa. They just have to wait.

I hear and understand your frustration about processing times but the best you or anyone who is waiting can do (if they have waited for a long time) is to contact your congressman and Senator and trust me it works.

When i got my LPR through the employment based category USCIS screwed up my PD and some one made a data entry error. I had to file FOIA, contact my cognresswoman to fix the problem and fortunately i got my green card in 10 days after contacting my congresswoman. So please do talk to your congressman/Senator.

One.

It doesn't matter that it is not fully operational. Each adjudication takes about 20 minutes. The rest of the time is spent waiting in the queue. So your file, waiting in a box at a not-yet-operational place, is the same as a file waiting in a box at a fully operational place. They are both waiting to be adjudicated. The new place may even go faster because there is not a backlog of cases, it will all be new.

US Citizens are waiting an extremely long time right now. The average processing time for an I-130 is 16.6 months per the USCIS website. And, from what I'm read, Congressmen and Senators don't help at all with their inquiries. You just are told to wait longer and longer. It is beyond terrible.

It doesn't matter that it is not fully operational. Each adjudication takes about 20 minutes. The rest of the time is spent waiting in the queue. So your file, waiting in a box at a not-yet-operational place, is the same as a file waiting in a box at a fully operational place. They are both waiting to be adjudicated. The new place may even go faster because there is not a backlog of cases, it will all be new.

Earlier apology accepted. Yes, the new place is new but haven't all I-130s from May on been sent there? Can't that be considered a backlog? They have to have hundreds of thousands of petitions just sitting there waiting to be processed by now.

You did not follow my question at all. I am asking you for data to show me that I-130 for F2A has been processed faster all the time than I-130 for IR cases and not the processing time from USCIS website for all I-130's.

I can say what you "Read" is wrong and cannot be generalized and i do know cases (including mine at least for my Green card) where Congressman/woman/Senators did help. You cannot generalize based on what you have "read". Each case is different.

It is up to you. Either you can put some effort in trying to do something about your case or just wait. Goodluck!

The recent development in the F2A visa category is not normal. It has never happened before. Its just a flash in a pan.

The current PD is not even going to last that long. In the next couple of months, its going to retrogress. That's what this category is all about.

Don't compare F2A with IR-1 because they are 2 different things. If IR-1 is backlogged, then thats your luck. Just be positive. Thats all I can say. I am also waiting for my spouse for over 2 years now.
