USCIS Giving Priority to Permanent Resident I-130 petitioners??

I'm a virgin on here also. Just joined a week or so ago, and this is my first comment to a post. Most people's comments appear to be quite helpful on here. After a person has been on here for quite sometime, I imagine they keep seeing the same questions being asked 100's of times from us first timers, and just get tired of it, maybe that's why I haven't asked any questions so far.I have found if I dig on here for long enough, so far every question I have, I have found answers for also. This is a great site though, I had no idea so many people were trying to either marry their loved one, or trying to get their loved one's here to USA.

I see we have a thumbs-up smiley face,good.gif maybe they will add a middle finger smiley face so we can reply to the a-hole comments easier.

Wow, that was nice. I was just inquiring as I've actually heard people say this in several threads. All I did was ask. I didn't say I believed it....my goodness.

I think I'm just going to shutup and not post anymore. I thought VJ was here to help people become informed, which is what I was trying to do, but never mind then.

Do you always go around VJ following people and telling them they need professional help or should get off of the forum? Quite rude.

You and I were talking before in another thread about how this process is making you extremely upset and despondent. We talked back and forth about it, about negativity. Then I find another thread where you seemed to find another thing to upset you. It seems like just a matter of time before you find the next thing to be depressed about. What thing will you find next?

Searching the internet for answers can be unhealthy. Especially if every little rumor is going to upset you. You were angry before that ugly people get denied visas, which as I hope you know was a lie. I told you it wasn't true right away but it upset you anyway.

To all others slagging me off: deserved perhaps, but I didn't mean it like that. I had already been speaking with the OP about his extremely negative emotions so a comment like that wasn't out of the blue. Everyone was new once and all are welcome do ask questions: don't be afraid. But if all you see on VJ is how your life is in ruins and how you will never be with your love and how ugly people get denied visas (not true) and how everyone is out to get you and everyone has faster timelines then you, then I think it's time for a break.

One thing I have learned NEVER do daily comparisons of who is getting processed faster than you, who is in AP longer, whey are so and so getting preferential treatment etc... Truth is, it is a ####### shoot... You might be a lucky one and get processed right away, you might be an unlucky one who does not... It is just how it goes in this random immigration game. Some months K1 is faster, then bam... Something happens and they slow down and CR1s speed up... And the cycle goes on... Just have your S$1T in order and don't worry about who is getting preferential treatment because when it is your time... You will be happy and lovin life... The least stress you can cause yourself, the better... Talk, visit, save money, whatever you need to do to pass the time... But worrying about what someone else is or is not getting or stressing about VJ horror stories is not a productive use of time and will only make this already difficult situation more difficult... My 2 cents

No, you are confused. You should get off VJ because all of your searching is causing you to believe crazy things and you can't tell they aren't true because you are new.

F2A is "current" right now, but all that means is that a visa number is immediately available. The case and processing is not immediate, it's just jargon. A F2A will still take a year and an F2A case is not prioritized over a citizen's. For now, a F2A works similar to a citizen's, but already next month it will no longer be like that.

F2A's have to watch VISA bulletin every month just to see if something will happen and spouse of LPR is not considered as an immediate relative but Spouse of U.S citizen is considered as an immediate relative (That logic beats me!) . I know the world ain't fair. But sometimes one has to just bite the bullet. If you think you have waited enough, please contact your congressman/woman or Senators to check with USCIS.

Because the I-130 submitted by a US Citizen should be adjudicated before the I-130 submitted by a Permanent Resident.

I try to imagine when it will be our time but just can't at this point. It feels like so far off. I can't wait to be happy. But until my wife and baby are here I won't be. Passing the time is hard to do. I can only go to the gym so many times and save so much money until my mind strays to my wife so far off. It's not easy. But I understand what you're saying. Well said. I'll try not to read the horror stories on VJ anymore. Thanks.

Yes a new center in KS just became operational that will handle our type of applications. Read on in these forums about these discussions.

Yes, I know about that new center. My I-130 petition got sent there. I just hope it's operational like they say it will be this upcoming week and that the backlog starts to get better.

Spouse of a US Citizen is an immediate relative. They are not bound by numerical caps where as spouse of a LPR is not considered as an immediate relative(that log always beats me!!) and are bound by numerical caps. Meaning only a certain number of spouses and children from LPR's especially from countries like India/China/Mexico and Philippines can immigrate every year. So since for IR/CR visa all you have to care about is processing time, for F2A visa they have to care about processing time and Visa bulletin. There is no priority date concept for IR/CR visa where as F2A are bound by Priority date, processing time, VISA bulletin.

Since there is a numerical limitation on spouse and children on F2A category, DOS releases a Visa bulletin every month indicating whether they have reached the cap or not and India/China/Mexico and Philippines are the most backlogged countries and it can change every month. So a person on F2A even if they get their I-130 approved, have to get it approved by the NVC and priority in the Visa bulletin has to be current for them and NVC will not approve if the Priority date is not current in the VISA bulletin. Generally the priority dates on F2A category are backlogged by 2yrs.

In August Visa bulletin, DOS made priority dates for even the backlogged countries to be current. How does it help? If I-130 gets approved and goes to NVC then NVC will process your case and completes it only if the VIsa bulletin says current for the applicant's priority date else it just sits there doing nothing

In my case, I-130 got approved on Sep 27th. I have time till Nov 1st for NVC to approve my case and send it to the consulate for interview. If the VISA bulletin for Nov which will be released around Oct 10th or so retrogresses for my priority date i just have to wait and NVC won't do anything until the VISA bulletin makes my priority date current.

So end of the day F2A are screwed enough and can take 2-3yrs to bring their spouse from countries like India/China/Mexico/Philippines and have to watch the freaking VISA bulletin every month.

Although, my best friend's LPR husband submitted a petition for her (a few years back) (she's a German citizen) and it also took about 3 years.

Seeing 19 days F2A approvals is still just disconcerting.

You need to understand there is about a trillion US citizens applying for their spouses. And.. they have to wait longer than those applying for F2As. Or K-1s.

It's just the unfairness of it ..

Especially for us, OverlandParker's. We don't even know when they will become fully operational.

Otherwaise don't envy the F2A guys or the faster processing presently, IR/CR is one hundred times better. Maybe those days it's little bit faster on F2A,

but still it is like every month you are afraid of the visa bulletin and regression.rose.gif

It is really wrost feeling I ever had in life.

It is like - you are almost at the final line and somebody can litterally "shot you"..

In Canada for example the emigrattion system doesn't make diference between LPRs/Citizens, EU also by the way.....
