I don't know if I'm in the right forum for this question, but I'm a USC and I'm marrying the love of my life who is here on a student visa, but got put on scholastic suspension, therefore he's not in school and is out of status. We live in different states and he's working and trying to get back in school, but so far has been unsuccessful. We are marrying in November, but he still wants to try to get back in the graduate studies program in the state he lives in. If we get married, do we have to live together in order to file for the green card. We would only be a part for 6 months. Also, he has some outstanding traffic tickets and he can't remember where he got them in Texas and he has not received anything from the court, so we don't even know where to start looking for the citations to pay for the tickets. Any help on these issues is greatly appreciated.

Your fiance is here on a student visa and he is no longer a student and therefore is out of status?

He is in the US on an out of status student visa and is employed?

The two of you are getting married while he is here in an out of status visa?

The two of you don't want to live together so he can finish a school he is not currently enrolled in?

He has outstanding traffic tickets and does not know where he got them?

How many red flags does one need? If I were you I would...Run, run like hell...

Well, that was the short version. There's more to the story. He's been here for 6 years. He came her on a student visa, finished undergraduate work, and started graduate school. We met last year and have been dating for a year. We fell in love. I've met his family and he's met mine. However, he missed turning in a paper for school and his grade was lowered which caused him to be put on scholastic probation at the end of the fall semester, according to the graduate program. He has been employed since he got here to the US. He files and pays income taxes. However since he has been out of school, he's lost his status. He is trying to get back in the same graduate program in the state he's in because if he transfers to a school here, he'll lose half the hours he's already accumulated under the master's degree program he was in before. Yes, we are getting married while he is out of status, which is not against the law from my research. I am an attorney, but I'm not an immigration attorney. He got two traffic tickets here in Texas in two small towns on his way to see me. One for driving without a license because he lost his status and the other for speeding. However, he lost the tickets while moving to another less expensive apartment. We've been trying to find them, but have not had any success. We want to pay them to make sure there are no warrants out for his arrest as a result.

I can understand that you don't know all of the details, but everything is not always black and white. However, if you have any useful or constructive information to help us, I would appreciate it, sans the judgment.

You are an attorney...ever heard of Lexus/Nexis? And I did nto intend to sound judgemental. I simply told you that I would run based on the information you provided in your initial post. But that's just me. Good luck..and God Bless

I thought this was supposed to be a helpful message board. People are under enuf stress as it is without having to deal with uninformed judgment, unsolicited advice and asinine suggestions like use Lexus/Nexis if ur an attorney. Really??!! I merely asked a legitimate question. Let me rephrase the question, do u have live together when filing for AOS?

I never judged you. That is clear. And I still don't judge you. And the suggestion of Lexus/Nexis was to help you find the outstanding tickets, warrants, etc... I forgot to mention CJIS and NCIC. It's possible to find those tickets if you so desire. You are overly senstitive (that is normal when one is under stress so I understand) and I'm sure you will be happy to hear that I will not attempt to help you any more as that is what you have expressed.
