Hello Guys!! I'm a newbie here. My passport expired for 5 months now and I don't have my AOS yet.I have been living here in US for over 2 years now.I came here thru Fiance Visa I got married but my problem is I don't file for AOS yet and so my passport was expired for 5 months now.My husband don't have plan to file me my AOS.So my question guys would be Can I still file my AOS even though my passport expired already?

This is just mess up, if he doesnt want you to file AOS than why is he marrying you, ..this is wrong

You need to get your passport renewed first. Then you and your husband have to come to terms about filing your AOS...soonish.

Completed: K1/K2 (271 days) - AOS/EAD/AP (134 days) - ROC (279 days)

You can mail your information to the Passport Office. You will have to see where the local passport office is for your consulate. For us the nearest one that processes passports is Chicago. We are not going to Chicago, but we are mailing it to Chicago.

Renew your passport. Why would the PI Consulate care about your status inside the US? The are there to help citizens of the PI that live in the US. There will be no problems. Then file for AOS and include the I-130 form with its fee so you can by-pass the removing of conditions as ou have been married for more than 2 years. You will also need to get a new medical done and have a new I-693 completed to send along with the form. Go to the USCIS website and look at all these forms and the costs. Find a civil surgeon in your area and ask what he/she will charge. You are looking at about $2000 to get this resolved, but you need to do this so you can live you life in the US.

Your husband should realize that you are currently out of status and should you find yourself near one of the borders--especially the Southern border--and come upon a CBP check point or a CBP officer pulls you over for some reason, you have no proof of lawful presence in the US and that can lead to detention and being hauled in front of an immigration judge. IMHO, for you husband to not file the AOS is cruel. You cannot leave and re-enter the US, you cannot work, and you are not accruing time towards citizenship. You are similar to a prisoner.
