Hi! New on here and stuck with M1 visa!

Hi,

A friend of mine recommended this site to me to help as she herself is going through a visa process. I have just received my M1 student Visa and am flying out to the states next month to begin studying.

My boyfriend is American and currently lives in the states. We want to get married but have no idea what we need to do! He called the US immigration and asked about fiancée/marriage visas but was told that I would not need either of those as I am already on a M1 student visa so will already be in the country.

I know that it is a very difficult process when a UK citizen wants to marry an American! So does anyone know what I need to do next? Any help is greatly appreciated!!!

Well first you get to the US on your visa.

Then you have to be married to a US citizen, so go get married.

Now click the guides tab in the menu bar and look down the left column--

"Guides if you are married". Bingo! You will be married.

Now look down below at the married options.

"US citizen and spouse both live/reside in the US". That's you. You will be here legally on a student visa and you will be married before you get to this step.

So click the link below that to find your step-by-step guide. There is a warning that you may not qualify. You do. Proceed with the steps.

Why this forum for the move? The OP has a visa so doesn't need advice to pick a visa. She needs to be guided to adjusting status from her student visa because that is the route taken when someone on a student visa marries a US citizen.

OP-- if you find this thread again, I think maybe you think you need some special permission to marry in the US. You do not. Plan a wedding, go to the county clerk's office for a marriage license, and get married. The permission you need is to stay here as a permanent resident....a greencard based on marriage to a US citizen.

Thank you for your replies! I am very confused about where to post what and just needed some guidance so I appreciate you answering me!

I don't know why this got moved to the "what visa do I need" section! I guess I don't belong anywhere else!!

And yes, I thought that I needed some kind of permission to get married to my American boyfriend! But at least I now know that I don't!

I dont know what to do next, ive been reading up on here and have figured that I need to apply to stay in the country after I am married. Is hard to know whether I'm allowed to do that whilst I'm on my student visa and how I go about doing it!

It's all very confusing! I apologise for being such a novice!!

An M1 visa is a non-immigrant visa.

It is immigration fraud to enter the US on a non-immigrant visa to enter the US with the intent to marry and adjust status.

If you disclose to the CBP officer that you plan to marry and adjust when entering on your M1 visa, you will be put on the next flight back to the UK at your expense.

If you make it through immigration at the airport, you can apply to adjust after getting marry. US immigration can make it difficult for you to adjust if they suspect you entered on the M1 with the intent to adjust. However, the burden is on US immigration to prove you had the intent to abuse the M1 and adjust when you entered.
