Remember, you are only hearing one part of the story. People could be being played by their partner and not know, or they have a scam marriage and don't want to admit it or didn't handle the interview as eloquently as they claimed.

I would bet at least half of the denials you hear about on here have a huge part of the story undisclosed.

England.gif England!

And in this crazy life, and through these crazy times

It's you, it's you, You make me sing.

You're every line, you're every word, you're everything.

Yah, agree. Probably more than 50%. I would also bet that people who are denied (for whatever reason) are more likely to post. Therefore, what you see posted here is not representative of the whole.

As many others have stated it is not a inalienable right to immigrate to the US. Every time someone lies, cheats, or abuses the system it makes it more difficult for those of us who patiently follow the law and procedures to bring our loved ones to live with us.

That said, the stakes are high. Proper preparation and patience is not only a must, it's all we can do. Follow the law and do things right and if your case is valid it's highly likely the visa will be granted. Not a bad deal in the end I think...

Posted (edited)

Long story short, no, it's not a right. Movies like "Green Card" make it seem like it is.

That being said, most people have straightforward cases that won't be denied. Just do your homework, make sure everything's in order, you'll be fine.

Given all of the denials I hear about on VJ, I don't honestly trust the system enough to think either myself and my wife, or other people, will "be fine". Nothing I could do or have done in this entire process makes me confident at all that my wife will one day be able to live with me. In my honest opinion, the processes in place are purposely made to trip up beneficiaries and petitioners, even if they're legit and being honest. I'm not saying you're wrong or anything and am not attacking your point of view, just stating how I feel about everything.

Your fear is in your mind, and not in reality. If you want to see all the approvals, go the the monthly filers threads and see post after post of "I was approved! Easy interview!"

Do you have any red flags in your case that you think will be an issue?

It is EXTREMELY rare to see what appears to be a genuine application refused.

I would be hard pushed to remember the last one and even then you do not have all the information.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

A green card is a privilidge, not a right. If you want to marry a foreigner you can always live in your spouse's country. The process went fairly smoothly for us because we were honest and provided the documentation required. Denials are not as common as you think.

There's a couple of things to consider, though;

- These days, a lot of people's first reactions to a problem is trying to find solutions online. This means posting in forums. So, when someone gets scammed/denied/etc, they'll likely end up in a very popular online immigration forum this.

- The truth is that not all countries are treated equally. Have you ever heard of a Nigerian getting a tourist visa? No, but in your case, from a VWP country, you don't even need a visa! Sadly, these things depend on that kind of factors. I can almost guarantee you that your wife's interview and process will be or has been easier than the process for a couple in which there are red flags and/or the beneficiary is from a higher-fraud country.

All I can say yes it is your choice to marry and its a privlegde to come to the United States for your spouse but going by the books and doing everything legal doesnt guarantee you get a visa,,,,,,,we front loaded everything .....and when it came to the interview and you get denied you dont get any answers they dont tell you why you are denied they just hand you a paper and tell you the interview is over..... then you email the embassy and then they tell you the case is closed and tell you to refile or get married....as in my case we never got legally married cause we didnt want it to look like a scam but now they tell us to get marrried and still dont tell us the reason we were denied in the first place.....and for all you people that think everyone that gest denied is lying or we are holding something back and what we are not providing all the details .... I for one am not lying .....and you must have been approved for your visa or you wouldnt have that attitude it is easy to slam people that have been knocked down and make opinions when you are approved its not as easy as you state even when you abide by all rules and regulations....So all I can say is believe what you want to believe (cause obviously since im a liar because i was denied) Just never take anything for granted this is like gambling you can lose without any reason .

You appear to be significantly older than your fiance and he is from Nigeria, a country notorious for scams. I don't think you are able to look at your case objectively. How much time have you spent with him? How did you meet? How long after you met did he tell you he loved you?

Poland is not a part of the VWP program and likely won't be for the foreseeable future, despite Poland's sending young Polish men to die in Iraq and Afghanistan, to my and my wife's dismay.

r06, You might want to get some professional help for your negative thoughts. It's not all doom and gloom. Have you started the visa process yet? Your timeline is blank. If not, what's the hold up?

Poland is a fairly low-fraud country and there is no need for your distress. VWP isn't a privilege given for being an allied country. The B2 denial rate in Poland is low so I don't see why you are complaining. The negativity only exists in your mind.

I hope you followed up on the ugly thread because the OP realized that his fiance never even had an interview scheduled yet so she just lied about having it. You got scared it was true and made up your mind that denials are capricious, yet that story turned out to be untrue.
