Hello,

My fiance is coming to the US from Italy on a K1 fiancé visa. He will eventually become a citizen, but in the meantime, would he be able to get public assistance? If not, is there a certain kind of insurance that he can apply for to help him before he is a citizen?

Thank you so much! Any info is appreciated!

May I ask what you mean by "public assistance"? If you mean means-tested benefits, then you may be held liable if he applies for those. That is what the I-864 is about.

To put it bluntly no. That is reason you (or a co-sponsor) are required to file an affidavit of support.

Are you asking about health insurance? Is there any reason he can't buy insurance on the open market or can't be covered on yours after you're married?

No public assitance for him which is why your required to provide proof that you will be able to care for him when he gets here and that he will not becom govt reliability. There are helth insurance everyone that you can get for him or if you have one with you job after you two are married you can add him to the policy.

Once you get married to him, if you have decent income, he will probably not qualify for most benefits.

Also, once he adjusts status and becomes a permanent resident (I'm assuming that's the plan here), the I-864 that you will have filed for him would mean that the government can sue you (the sponsor) for means-tested benefits that he gets. However, this is only after he becomes a permanent resident.

Medicaid is a means tested benefit. It is welfare for the poor.

An Legal Permanent Resident (LPR) is not eligible for means tested benefits for the first five years.

When an LPR receives a means tested benefit (even when eligible), the I-864 sponsors are responsible for reimbursing the government for benefits received.

Done with K1, AOS and ROC
