BAD AOS INTERVIEW- Must Read!!!!!

We had an interview for my aos from B1/B2 visa. And geez this kills, it went pretty bad. ;(

We don't have a lawyer. Our interviewer was a man in 40s 50s, very tough white guy who had this unpleasant expression on his face all times saying i-hate-immigrants-in-my-country. No really, he was also a police officer. He started off with general questions, how'd you guys meet etc etc confirming infos on forms. For evidence we brought some pics, not alot. He hardly look at those. We had lease, phone company joint account with family members, electricity bill, bank account letter. We really couldn't get anything else since i only got my ssn a week before. He asked one year of marriage and this is all you have, i tried to tell him that i didn't have a ssn and we couldn't do much without it. I don't think he considered that at all.

He then pulled up stuff online and asked why do we have utilities on my bros name in our apartment. We told him that he had an att uverse account and using his account could save us equipment charges. He then started inverstigating my brothers info, asking me where he lives and his dob. He lives in another state and moved only few months ago, he said he lived in his old address until march 2013, which is not true, he used to live there 2 years ago! idk how he got that false information.

He asked me questions about my brother, it made me nervous. Like how he got his citizenship and stuff. And then stuff that was unrelated to my case. I felt nervous. He then seperated us and asked my husband questions, he said things like he's been doing this for 17 years and he puts atleast 20,30 people in jail everyyear due to immi fraud. My husband explained to him that i had only gotten ssn a week back and there was not much we could get, we didn't have a religious wedding because he is trying to save money for school and i don't work either. I think he was really suspicious and wasn't listening to anything he was told. In the end he gave my husband a RFE saying 'submit more evidence like bank accounts, phone calls, joint properties, tenacy etc etc' in 80 days.

We are so worried and i can't stop thinking about this, if this case got disapproved my life will turn upside down. I don't know what will we do about our marriage, we only started to get on our feet recently when my husband got a new job after he lost his previous one. And now our whole future and marriage is on stake, i am from Saudi arabia, if God forbids this case is disapproved, it can take him years just to get a saudi visit visa.

Now, about RFE, i don't know what to do. My husband is thinking about car insurance, health insurance, pictures from my sisters wedding that is coming up soon. He has also told me to start using the bank account we opened. I had the debit card but always used my old card, so transactions from my sides are zero.

Please help guys, if anyone has gone through similar situation please please help.

7/2/2013 - USCIS Mail notification received (all the forms are received and are in process)

 

 

 
7/3/13- Biometrics letter received- for 7/19/13- Day 13
 
7/9/13 - Early biometrics done! - Day 19

 

 

8/5/13 or so - Status changed for Ready for scheduling

 

 

8/20/2013 - INTERVIEW SCHEDULED FOR 9/20/2013

 

 

8/21/2012 - Interview Cancelled! ;(

 

 

8/22/2013 - 2nd interview scheduled for 24th September.

 

 

8/27/2013 - Online update - EAD card ordered!

 

 

9/5/2013 - EAD card received

Sounds like you guys were a bit under prepared...you should have more evidences, he is right on that. Good luck collecting more evidences in case you guys need to submit more (I hope not) and maybe a couple affidavits from friends/relatives might also help in (if notarized). Alternatively, if you guys get AOS denied, I wonder if you could go through consular processing from Saudi. I am totally talking at the top of my head, I don't know how that goes honestly. But if you guys truly love each other you guys will find a way to live with each other whether through a longer process back from your home country, or maybe even in your home country. Love survives everything, even not so nice living conditions that seem insane to the right mind without love. LOL :) Good luck!

Timeline

Don't give up yet... like ALS mentioned it just sounds like you were a little unprepared.

Go to your bank with your husband and have your name added to the account ( it not already done). When I had no SSN my husband added me as an authorized user to his credit card...no SSN required. I know a lot of utility companies will only have one name on the bill, but put a bill in your name. When you submit bills with your husbands name, and some with you name, all with the same address it demonstrates you have co-mingling.

Also, if your husband works have him add you as beneficiary. If you have health insurance, add your name to his policy. If you rent where you live and only one name is on the lease have your landlord write a notarized letter stating you both live there together as a married couple. Then when it's time to renew have him draw up a lease with both of your names.

I understand your reason for having your brothers name on the account but for the sake of your AOS it might be wise to just put it in both of your names.

Search for evidence of a bona fide marriage and go down the list. I never had a social security card either...it definitely makes things easier when you do but its not impossible!

05/07/2013 (day 36) - Biometrics appointment completed in Baltimore, MD

05/15/2013 (day 44) - I-485 updated to Testing & Interview! No changes for EAD or I-131.

05/23/2013 (day 52) - NOA for interview date and time received in mail

05/25/2013 (day 54) - NOA that our interview has been cancelled. No updates for EAD.

06/05/2013 (day 65) - Online EAD update to " Card Production"

06/06/2013 (day 66) - Online update that interview has been re-scheduled for 7/10 smile.pngsmile.png

06/07/2013 (day 67) - NOA in mail for scheduled interview 7/10

Well so right now, our options are to

- Get a health insurance and add my name

-Car insurance with both our name

- Proof of transactions made with our card.

-Some more pictures at a family wedding coming up i suppose?

So idk how to remove my brother's name on from utilities, the account was the one he used to use and it was transfered. We can certainly try but is it even worth it. The officer knows it was on my bro's name and he pointed out, would he not say why is it transfered now? just to show them?

Secondly do you guys think they will visit our apartment, idk how much chance there is. I feel indifferent, on one hand it'd be scarry on the other hand it'll prove to them that the marriage is real. But since they just didn't let us go and ask us to wait for answer, instead they gave us RFE, it doesn't look like they would. Am i truly right?
