American with a Canadian girlfriend and two kids in Ontario

Hello I am an American in Los Angeles with a girlfriend in Canada who gave birth to twin babies one boy and one girl yes they are mine and I am wondering should I file a CRBA for them and then a K1 visa for her or is there a better way? I am not allowed in Canada due to a DUI. Thanks for your time guys.

Go ahead and get the kids CRBA done.

You can do the K1 fiancé visa or the CR1 a spousal visa.

Since she is in Ontario she would interview in Montreal. So either visa would be almost the same amount of time.

So if she wants or needs to work right away and the both of you don't mind being Married while you two are apart then the CR1 would be a good choice. I think it may be slightly less expensive in the long run also.

If you two don't like the idea of being married and separated, and if she is ok with not working or leaving the US till after you get married and file for adjustment or status plus 3ish plus months till she either get her Green Card or Advance parole and work permit.

File the CRBA for the kids and get them US passports.

The K-1 is the way to go for the two of you since you cannot go to Canada. You can file for the K-1 today if you have met face to face in the last 2 years. Once she enters on the K-1, you can marry and file to adjust her status to a green card holder.

The spousal visa would require a marriage certificate. She would need to visit the US, marry you, and then return to Canada to wait for a spousal visa.

One way or the other, she would need to come to the US to get marry since he cannot go to Canada. It would simpler to file for the K-1 now rather than wait for her to travel to the US, get marry, and wait for the marriage certificate before they can file for a spousal visa.
