Student visa denied now I'm applying for K-1, need help!

Hi, guys! I have a gay partner and We were not planning to get marry since August 2013, so I was applying to a student visa and it was denied without prejudice. Now with this K-1 option my bf asked to marry him. My question is, I paid the SEVIS fee (I901 Student And Exchange Visitor Information System) and I will not intend the college anymore, is this gonna be a problem to apply for the K-1, since the fee still activate? Do I need a lawyer on this case? I was filling out the papers by my own but I do not know now.

Timeline

I think it will be ok if you apply for K1 visa.

My friend had the student visa denied as well and now he is applying for K1 visa.

He got the approval and now he is only waiting for the interview in Rio.

As long as your relationship is true, it will be ok.
