i have had 2 b2 visas visiting a ex before but this did not affect my K1 application at all. I never overstayed .

Im pretty sure it wont effect you at all. They did ask me about him and i was honest at the interview and said we are just dating and do not plan to get married and i still got approved.

2013-08-20 (DAY 8) Noa1 received via Text around 11pm, next day was email. Received my case numbers

2013-08-23 (Day 11)- received hard copy in mail for Noa1 gc , Work permit

2013-08-30 (Day 18) Received Biometrics appointment letter in the mail.

2013-09-17 (Day 25) biometrics appointment day @2pm Detriot

2013-09-25 (Day 33) received text and email , I485 changed to testing and interview

2013-10-02 (Day 40) received text message and email @7am about my interview date

2013-10-04 (Day 42) Received hard copy interview letter in the mail

2013-10-10 (Day 48) Work permit Card in production

2013-10-16 (Day 54) 2nd Text and email @830am Work permit in Production

2013-10-21 (Day 59) text/email notice 10am . Work Permit sent

2013-10-21(Day 59)Text/ email @9pm received text with tracking number -2 day delievery

2013-10-24(Day 62) received my work permit in the mail.

2013-10-25 Filled for my Social Security number today

Thanks Pamala - that's good to know and good to hear from someone that has also deal with with the embassy in Australia.

I guess the difference between your situation and mine is that I misrepresented my situation and you did not. Hard to know whether they will accept my explanation or treat it as fraud. I guess only time will tell...

well, if the officer didn't see this post then nothing can be held against. Though it is illegal to even have to mere thought to get engaged to someone before you get on plane to travel to the US and doing it is illegal, ALSO YOU DIDNT MENTION YOUR RELATIONS WITH YOUR BOYFRIEND TO THE IMMIGRATION OFFICER FOR A REASON..... I suppose. You just have to state your story and stick to it now, cause if you confess you will be sent back home....possible bar from the US for a time or indefinitely..... keep going forward if you choose..... Please don't take offense to what I say, nor am I coaching you but if you start on fib it rolls into another.... memory, assertiveness, you deem it worth it to get this far...... you can only do what you think is right....

hi guys,

I have a similar situation as Tammy, I have been refused a U S visa for the second time. under both circumstances I applied as a tourist with an invitation from my fiancée's stepmother and deny know any other person apart from her (step mother) during those previous interviews.

how can this affect my chances since am about going for my k1 visa interview in South Africa.

no offense to Tammy, but the difference between you and her you told the truth.... The K-1 visa shows you are willing to get married to your fiancé in the US..... within the 90 days after you land here. If you don't marry here in that duration time MUST GO BACK HOME. Some officers give people the benefits of the doubt and even if they tell the truth they grant them a visa. Depending where you are from makes such a difference, cause by statistics they can classify where a fraudulent crime will arise cause it happens so much....Anyhow....K-1 Excellent choice.... As I said if you aren't marrying her when you come here, you must go back home.... Just have the proof showing you have known her for 2-3 years or however long you known her and you should be set after applying for the K-1

Hi everyone

I am from Australia and am currently visiting my fiance here in the US on a B2 tourist visa. When applying for the B2 visa, I told the embassy that the purpose of my trip was tourism, and did not disclose that the primary purpose of my trip was to visit my then boyfriend, now fiance.

At the time I did not consider this to be a risk, as I had no intention of overstaying my B2. However, after reading some of the posts on here, it sounds like what I have done may impact our chances of getting a K1 approved.

Has anyone dealt with this situation? If so, can you provide some info? Anything would be great - freaking out a little bit!!!

Ignore the "Doom and Gloom"ers here. From what you have said, there shouldn't be any effects on a K-1. You did not come to the US on a B2 visa with intent to get married. You have visited sites in the US, just because you did this with your boyfriend now fiancee does not invalidate your statements about tourism.

You have nothing to worry about. Heck, there are people here who came to just visit the US on VWP and ended up getting married. So you really have nothing to worry about.

If you are both serious get marry B4 departing, leave at least 3 wks

before the 6 months, and then he can file for you as his spouse, take lots of

photos , have him come to visit U after 6 months of your leaving, the process

should take about 15 months ..not a lot of time apart if you're both serious.

6 months spells by only you being here, will show you are not working in your

own country and may harbor immigrant intent to CBP causing refusal to let you

in after a couple times doing that

Unfortunately, I don't really remember the specific details of the conversations I have had with US officials.

I just know that when asked about the purpose of my trip I responded with general statements about tourism. I did not bring up my girlfriend, and they did not ask.

So I guess I didn't lie, I just didn't tell the whole truth...

Hi Tammy!

I went to US with my B2 Visa to visit my boyfriend and we applied for K1 Visa while I was there. I made a research before and talked to a lawyer, and the information I got is that I could do it inside the US.

While filling the I-129F there is a question asking if the fiancee is in the US during the date of application, and if the answer is yes, they ask for the I-94 admission number.

And we were approved, no further questions about it, so I guess it is not a problem at all.

The problem will be if you don't leave the US before your I-94 expiration date, or if you get married in the US during your stay.

But you can definitely apply for the K1, go back to your home country when your stay expires, and wait in your country until the end of the process to go back. (because once you applied for the K1 Visa, you cannot travel to US again until you get you K1).

it only took about 5 months to get our k1 visa. Worth the wait. Faster in Australia
