Must immigrant name be on tax return for I-864?

Timeline

Hope someone can help me answer this question.

Just some basics about my situation.

- I am a u.s. citizen

- My wife is a korean citizen

- we are both in korea, wife is applying for immigrant visa.

- we are at the stage where she goes in for her interview

I have been preparing documents and everything has been straight forward so far. The only document that I am worried about is the I-864. Since I won't be employed when we get to the states, I need to also submit a I-864a, someone who can help support my wife. I have all of her tax return information. The problem is, this person (who will be the "Household Member") did not list my wife on her tax return. Will this create a problem for us?

If anyone has any experience about this, your help would be really appreciated. Thank you.

I'm going to assume that you filed DCF in Korea, and to do so you have to be a resident there. With that said, your joint sponsor signs form I-864 not I-864a because you don't live in the same residence. Form I-864a is only signed by household members who are including their income, in addition with the joint sponsor's income, to help meet the poverty guideline.

To answer your question, your joint sponsor doesn't need to include your wife on her tax returns. She only counts your wife in her household size on form I-864.

Your co-sponsor need their own I-864. I-864A is the wrong thing. You can't say a person in the US is a household member when you are in Korea.
