Hi everyone! I am about to send out my i485, i130, i765 package but I am stuck on the i864 sponsor form. Any help would be very much appreciated.

Okay, so here's the story. My hubby (USC petitioner) does not meet income requirements. So we already have a joint sponsor.. That's all good to go. She had complete documents 3 years of her federal income tax return, paystubs, w2s.. Etc. Now, the problem is my hubby. He has his federal income tax return (as well as 1099s, he was only earning commission basis as an agent) for year 2012, 2010, but 2011 he doesn't have one since he didn't file for that year cos he had no income. However, we were based in Manila, so he had a job there from 2008 to 2012 (including the 2011 year he didn't have income from the US) that paid very minimally.

What should I put in the form where it says total income for 3 most recent years? Should I put $0 for 2011?

Next question is should I just send in the federal income tax return and 1099s for the mos recent year 2012? Or would it be better to send in 2012 and 2010 and have a written explanation for 2011 why he wasn't required to Ike since h had no income? (Does the income from the Philippines matter or not?)

Or will they not really dwell on his i864 since I have a joint sponsor with complete requirements!?

Please help me!! I really wanna send this out already! So stressful

If I were you Id just sent his 2012 tax forms and w2s..sending 3 years of tax forms is optional,plus if he doesnt meets the requirements..if you joint sponsor meets the requirements and has all the supporting documents then you are good to go!

09-10-13 (day 00) : AOS Package sent

09-12-13 (day 02) : Package delivered

09-17-13 (day 07) : Texts / emails received

09-23-13 (day 13) : Only one NOA hard copy received

10-07-13 (day 27) : NOA hard copy for I 485 received (NOA for I 130 still missing)

10-09-13 (day 29) : Biometrics letter FAXED, appointment for 10-11-13

10-23-13 (day 43) : Online status changed to "testing and interview"

10-28-13 (day 48) : Interview appointment letter received - Nov 27th

You can send only the 2012 taxes. On a separate note, I'm no expert on this, but I think he needed to file a return for 2011 (probably paying zero US tax due to the foreign income exclusion). So I think he would need to file that return (regardless of immigration issues).

But if he had no income or no job oversees for 2011, he wouldn't be required to file taxes, right? Just wondering as this is all so confusing.

So you guys think I should just send in my hubby's 2012 ITR? But what about the part on the form where I have to put his yearly income for the 3 most recent years? What do I out for 2011? Do i put $0?

But there's also the question about the total income from last 3 years' tax returns.

You can send only the 2012 taxes. On a separate note, I'm no expert on this, but I think he needed to file a return for 2011 (probably paying zero US tax due to the foreign income exclusion). So I think he would need to file that return (regardless of immigration issues).

The OP said the husband had minimal income. If it's lower than the level that requires filing taxes, then filing taxes is not mandatory. (It is sometimes nice, because you often get money back; but it's not mandatory.)

You can put "did not file" or something. Per the I-864 instructions, if he did not file for one of the years because he was not required to, he needs to attach an explanation for that.

Please please please help me and let me know if the letter below sounds okay? This is the only thing left to do and hopefully i get to send out my package by today or tomorrow. SO really need your comments suggestions etc for this. thanks smile.png

Don't say "did not work in the U.S."; whether the income was in the U.S. or not is not relevant. Say that he was not required to file because is income (regardless of from where) was so low. Here is the 2011 Form 1040 instructions. On page 8, there is a chart for at which income you are required to file.
