I applied for my SSN about 12 days after my arrival in the U.S. and in my maiden name; received the card within 2 work days in the mail. After the wedding I went back to the Social Security Office and changed my name to my new married name. No problems at all.

Edit: Wait - you are saying that you came on a K1 visa, but in your information to the left it states F1 visa. Which one did you come on here?

Did you still send I-765 with i-485 despite the fact you applied for SS?

Yes, you send the I-765 and I-131 with the I-485. An SSN is not even required to file for AOS. You use category (c )(9 ) on the I-765 because you are applying as an adjustment applicant.

K-1 visa holders are not allowed to work with just a SSN.

However, most file the AOS set, the EAD filing fee is waived, and BOOM - can work about 90 days after the EAD is filed (after marrying, of course).

If you are thinking to work, legally, in the USA, you cannot, until you have 1] EAD and 2] SSN . or 1] greencard and 2] ssn.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

A K-1 is eligible to work, but they must have an SSN and EAD in order to do so. It cannot be just one or the other. It must be both. The SSN a K-1 holder receives will come printed with the stipulation, "VALID FOR WORK ONLY WITH DHS AUTHORIZATION". That authorization would be the EAD. After you receive your green card, you can return to the SSA to update your status to permanent resident and your new SS card will come without that statement on it.

It is getting close to the end of the year and it is good to have a SS number for tax filing purposes with your spouse, even if you do not have your EAD yet.

Thank you. I guess you can use the SS # to apply for driver's license and wait for EAD to be eligible to work.

Well, it depends on your state's DMV rules. In Oklahoma I could not apply for my DL/Learner Permit until I had my EAD.

most drivers license offices know enough to learn of your status.

for example - you just hit USA dirt , 2 weeks pass, and you get a SSN.

the dmv office will look at your 'legal status' - learn your I-94 expires within 90 days, and refuse to issue you a drivers license, state ID, or in some cases, even refuse to offer you the written test.

Why? Legal status is important. as far as they are concerned, you hold the same creds as a tourist visa holder, so is useless to chase after a drivers license until after you have SSN and EAD in hand (or SSN and green card) which only occurs after filing the big AOS set, which you can only do after getting married.

Have you studied the K-1 flowchart in the Guides? If not, I invite you to take a look, nowish.
