Hello Everyone!

I posted this in the AOS forum as well, but wanted to seek the advice of my trusted Vietnam VJ friends too.

My wife's I-94 is set to expire December 28, 2006. We were married November 22, 2006. Prior to my wife entering the United States on her K1 visa, I was living/working in Ho Chi Minh City, Vietnam (where we met). I moved back to the United States with her the end of September, and returned unemployed. I have recently accepted a new job that will begin on January 2, 2007.

We are currently living in St. Louis, MO, however, my new job will relocate us (the end of December) to Arkansas.

My questions:

1. Should we file for AOS from our current St. Louis, MO address within the 90 day I-94 validity and just file address change forms after we are settled in Arkansas, or should we take the risk of her being 'out of status' for a couple of weeks and wait to file after we are settled at our new Arkansas address?

2. For the I-864, has anyone had any experience in initially submitting a job offer to satisfy the proof of income evidence? I will not start officially working for the company until January 2, 2007. We are currently packing up and waiting for the movers to relocate our belongings to our temporary housing in Arkansas.

3. As many may remember, my working situation in Vietnam was for that of a private Vietnamese company. When I returned to the United States, I returned unemployed. Is the I-864 affidavit of support heavy on past earnings or future earnings?

Thanks in advance! This is such fun trying to get AOS organized while being in the middle of a relocation!

Is there any way you can list your temporary housing address address or get a PO Box in Arkansas and file from there prior to moving? I can't speak from experience but I can forsee a real mess if you file in MO and then try to change addresses. It might slow things up considerably that way.

My understanding of the I-864 is that it weighs on the past year's income only. How current or future income is viewed during AOS at the interview, I cannot speak to.

2.) Do a simple Change of address with USCIS afterward, after you're settled (what happens if Arkansas doesn't work out?)

3.) Don't worry about income situation

Hi patricks,

Thanks for the advice. She seemed to enjoy it down there (Bentonville, AR) when we visited last week during our pre-move trip. However, I can understand your analogy.

So, you say don't worry about the income situation? I'm guessing they (i.e. USCIS) already have all my paperwork from the I-134 Affidavit of Support that we sent in for her interview at the US Consulate in HCMC. Is this part of the reason you are saying don't worry about income?

Do you think a job offer letter will be sufficient evidence to initially send in with the I-864?

I'm guessing a PO Box address in Arkansas could be arranged. I'm not worried about the address in STL. We've been staying with my parents here, so this address that everything is on record now won't be changing. At least we won't have to worry about lost mail, etc.
