K1, J1 or what? Help please!

Hello!

My fiance comes from Jamaica and has worked in the US for the past 3 summers on a J1 visa. He proposed to me in August, then had to go back to Jamaica to finish college. He wants to work again next summer here, so we aren't sure which visa to apply for, that would allow him to work when he gets here. If we file the F1 and get married, he will have to wait to work. If we file the J1 and get married while he is here it will be visa fraud. Any suggestions? I fly there in January for 2 and a half weeks, but want to wait until we are together in the US to get married! Please help!! Thanks

September 1, 2010: Switched course from K1 to CR-1
December 8, 2010: Wedding date set; it will be on February 18, 2011!
February 9, 2011: Depart for China
February 11, 2011: Registered for marriage in Wuhan, officially married!!!
February 18, 2011: Wedding ceremony in Shiyan!!!
April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

rules are marry him down there, or apply for k1.....If he comes up here and you marry him, especially with the question you just asked.... you both will be in trouble. The K-1 you need ample amount of proof to show you guys been together, but no financial questions will be asked....as opposed to marrying him down there and coming up filing the I-130 and so on and so forth.....If you are that anxious...file a K-1 now, and show the proof you have been together.... as far as processing times, not sure for the K-1....don't compare your situation with anyone..... everyone has different service centers....good luck

oh yeah, the process for K-1 isn't as extreme as I-130....and he can focus on school more. when he gets here on a K-1 you have 3 months to get married or he goes back home....I-130 once he is here, HE'S HERE..... So if your relationship is still uncertain even though he proposed....K-1. If you want him and your positively sure I-130

Hi Michela,

Thanks for responding! We definitely want to get married.It is really hard being apart! I don't want to get married there then come back here alone :( I am thinking the K1 visa is the best option, with him taking off next semester of school so that we can get married then upgrade his status before his managerial position begins again at the summer job here in the US. Then he could finish his schooling here! Thanks again for the help as we begin our "journey"!!
