I have used the AP within the last month without any troubles, even if I had a period of 4 months of being out of status (my 90 days were up, October 1st, applied for AOS in February, next year). Other than being taken to secondary (which I knew would happen), no problem. I also got a new stamp in my passport, that I was "paroled into the US" based on pending AOS or smth like that.

So, if you have been out of status for under 180 days, you can use the AP without any issues.
