So we just checked online and it says our waiver was denied. We haven't got the letter as to why yet, but have some questions. First i was reading if your in removal proceedings you can't file a 106a waiver is this correct or am I reading it wrong? Also what is the next step after its been denied?

im no expert but refile or appeal but wait first to find out why

can you think of any reasons why it would be denied

i will be joining the waiver club soon as i have 1 simple caution for theft of a traffic cone i found in a hedge <<<< ( no intent to keep )

please give details about your case

Well our lawyer seems to be a joke. He was supposed to review my hardship letter and after he had it 3 months I asked what was going on and he just got mad and said he mailed it. I think he mailed it in June... which is why I was shocked to hear something so soon. My husband got pulled over last July and got arrested for driving with out a license. His first immigration court date was that Sept but they called and said they extended it to Oct 15. From what I'm reading it says if u are in removal proceedings you can't file unless your court is administratively closed which ours clearly isn't. We just got married and don't have kids so I'm assuming that is why they denied us.

I did hardship letter and we don't really have much besides financial and my few medical problems. If he goes to Mexico I will be homeless cause we live where he works and get a discount for my horses board. Without his income I can't afford a horse and an apartment. The lawyer told me he was going to look at my letter and make some changes and he had it for 3 months and I kept asking and he just sent me an email saying he mailed the waiver off. I'm confused now that I read u can't file a waiver in removal proceedings. One of his friends was in removal proceedings and got is I485 approved and his lawyer got his court case closed. Ours said it was impossible that they want proof we filed the waiver....
