what status do you hold, really,

and which visa is your Mom chasing?

I ask, because you mentioned an I-140.

I know LPR is to remain in the US, but what can we do if she has younger children back home,that is why she will return home and return to the states frequently not to loose LPR status.

I have talked to people around to find a cosponsor for my mother. Once she gets her visa interview, that person will fill out the i864. Hopefully everything goes well, she comes to the US. I think its even a good idea to apply for all kids even the one over 21, the younger one will get to come in about 2 to 3 years and the two older one wont loose anything in 7 years. Once she petition for them, she will go back home to be with siblings, and travel back an forth until the minor kids get their visas then she can stay in the US. The kids that are older than 21, will have their visas around 2020... and I can sponsor them since I should have a job them. I hope so lol

Is a doable plan? any flaws?

I've read other VJ scenarios kind of like the one you are going through, but this involved one parent staying behind to take care of the children while the other petitioned the children. Can't one of your older siblings take care of your younger one? Maybe others can chime in on why your plan may or may not work.

it seems like you are over excited about your situation . like others said lets focus on:

1- Relax eb0dfafc.gif

2- your mother

2- You find a decent job or your wife or find someone who can be co-sponsor

3- If you file now wait for a minimum of 12 - 18 months when you will see your mom at the port of entry in USA.

4- Your siblings, the youngest which you indicate is 16 will 98% age out before they schedule for an interview. Don't look at the processing time and predict its 100% 12 months for your mother and 2 years for your 16 years old. when they ask for a missing document, it sometimes takes 3-6 months to get that exact piece and gets processed. there is AP which sometimes takes between 6 to 18 months after interview, which in your mother case is less possible.

A green card means that someone is committed to living in the US more than not. Anyone who is "visiting" every few months runs the risk of being denied entry and having the green card taken away. Maybe the right thing is to wait until the children are grown and she can come to stay.

This will not be over quickly. You will not enjoy this.

I know about that scenario and we thought about it but the process will either be to hard or too long. she doesnt want to leave them behind...

NigeriaorBust : I know what you mean but I know a lot of people that have 10 years green cards that comes and leave, as long as you are not out for too long and. In her case we will even go further to apply for reentry permit in case. Waiting for the kids to grow up will not be a good idea because no one know what the future holds and it would take 1 year for my mom and 7 years for the kids... 8 years... thats too long. But thanks for the suggestion.

4- what about the 19 yo? If you file for your mother now I mean today it will take an estimated minimum 12 months IF everything the governor need and you provide. Then your mother will be in the US by SEP 2014 (luckiest case). There is a glitch in your case : 1- YOU, the main petitioner is not making enough money so the big bosses WILL dig deep into your co-sponsor to make sure they can afford to supply help when needed. This mean once you send your document to DOS and they suspect one document that is not fit within the rules, they will ask you to send this or that BUT here is a catch which is TIME. how long those files stays at their desks? TIME when they decide to inform you to send required documents ? TIME when you receive their letter and how long does it take you to gather those docs? TIME when you send those docs how log it will take for them to open your envelop and look at it? TIME. so in some occasion this circle take 2-3 or 4 moths.. then interview and IF your mom is lucky which in most cases older people are, when it comes to AP, they pass your mom will be in the US in Jan 2015. Your minor 16 turns almost 17 years old and 6 months - TIME -. Your mother files for her minor at this point it takes 24 months before they can be scheduled for an interview. That means your minor will be around 19 or 20 years old when he/she will be scheduled for an interview, this is again, IF all the documents are at the governor's satisfaction level. And since your minor will be 19/20 years old by that time he/she will definitely go through AP which again there is no guarantee, luckiest people come out of AP is 6-8 months that means 98% your 16 years old will hit 21 YEARS OLD of age. That means minor is NO more minor and have to wait another 5 years for his/her petition to be considered. Don't even think of other sibling that you mentioned is 19 now through F2A. Its better for you to file for that 19 years old it will take around 12 years .

5- Lastly what do yo mean "there is AP which sometimes takes between 6 to 18 months after interview. http://travel.state.gov/visa/a_zindex/a_zindex_4353.html . Elderly applicant are likely to go through this, in your mother case, she might not go through this.

About the i864, I made way more than the poverty level on 2012 Taxes. If they ask for the i864 by the end if the year or early 2014, I could just send the i864 with only my 2010, 2011, 2012 tax that is way above poverty line. Can I do that and chance it? If its not enough they will send me an RFE? I'm worried they may ask for pay stubs which is optional. What can do at that point? Or i shouldnt do it by myself just with my 3 years taxes? My cousin did for my aunt and she only sent her 2011 tax with pay stubs and everything was fine... I guess she was lucky and the whole process only took 9 months...

Now we are waiting for i130 to be approved, I think I should start preparing what they are going to be asking next.

About the i864, I made way more than the poverty level on 2012 Taxes. If they ask for the i864 by the end if the year or early 2014, I could just send the i864 with only my 2010, 2011, 2012 tax that is way above poverty line. Can I do that and chance it? You are required to send your last/latest 3 years tax transcripts - Pay stub and back account statements are optional but they might ask.

If its not enough they will send me an RFE? I'm worried they may ask for pay stubs which is optional. What can do at that point? Make sure TIME is important than taking chances . Its government lever matter, they make sure you are able to support the beneficiary, taking chance is again an option if asked for more document and you cant provide all the TIME and money and HOPS are all gone. Everyone case is different - always try to not leave a gap in the middle or they request more documents and as I said before its all TIME that is going to be wasted.

You said I should just do it for the 19yo, but wont be better if my mom does it anyways it will take 7 years instead of 12 if I do it? your 19 years old sibling can not marry until he/she gets to the US. he/she has to wait for 7 years again its not exact 7 years. once he/she gets married- petition becomes invalid, unless your mother becomes a USC then the status will change again it will be around 7/8 years + . I don't know how is your mother's situation but most elderlies from foreign countries find it hard to pass US citizenship test and all the requirements, I am not saying its in your case .
