Hi all,

We are a K-1 visa couple hoping to submit our AOS package within the next few days but have run into a few problems we need to resolve before we can send it off.

Firstly, it says on the VJ AOS checklist that a copy (front and back) of the i-94 form is to be included. However, to the best of my knowledge, as of this year the i-94 has become automated and you are no longer given a hardcopy of it. This is what we were told when applying for my social security number and so I am assuming that the checklist is just outdated. I have retreived my i-94 admission number online from www.cbp.gov/I94 .

Would a copy of a printout of the webpage containing my i-94 number retrieval suffice as evidence or is there some hard copy of the i-94 form we need to obtain somehow?

Secondly, I have read many contradticing things regarding the i-693 form for K-1 visa holders. It seems that there is a grey area with the USCIS, where some people receive RFE's and some don't. I have my DS-3025 form with my vaccination information stating that I meet all of the vaccination requirements, which is (substantially) less than 12 months old. Is the general concensus that we should contact a civil surgeon before submitting the package to fill out a i-693, or just submit the DS-3025 form and wait to see if we receive an RFE?

Yes, just print out the I-94 info from online and send that with your AOS paperwork.

If your DS-3025 has everything marked off and is completed correctly, then I would skip the civil surgeon and I-693 unless I received an RFE telling me I had to get one. You may not get an RFE and then would not have to worry about finding a CS that won't rip you off. You will get conflicting opinions on this too. It is entirely up to you to decide which way you want to go on this issue.

AOS Journey

11-04-2011 sent AOS to Chicago lockbox

11-07-2011 delivered

11-08-2011 Date on text messages but did not receive until 11-22-2011

11-23-2011 Check cashed.

11-25-2011 Hard copies of NOA1s

12-06-2012 Pui's Brother unexpectly passes away and we make an info pass appointment and receive an emergancy AP so she can return home. Pui leaves for Thailand for 2 weeks.

12-06-2012 Get a text message and email that she received an RFE

12-12-2012 RFE for original birth certificate. I swear we sent it along with a certificate translation of it.

12-20-2012 Pui returns from Thailand.

12-21-2012 We send the RFE back for with original birth certificate along with a new certificate of translation(I had to wait for her to return for her to sign)

12-26-2012 text and email they have received the RFE.

12-29-2012 Appointment for biometrics is 01-23-2012

01-13-2012 AP is approved.

01-23-2012 Biometrics appointment. Later during the evening the text and email saying the EAD is approved.

01-31-2012 EAD/AP combo card arrives.

05-22-2012 Email and text card is in production!

On my DS-3025, the civil surgeon overseas wrote that the record was complete in the results section, but he did not make a notation in every single vaccination field. I eventually got a RFE for my vaccination record for AOS.

I'd say if your DS-3025 looks filled out correctly it will be enough, don't worry about sending a new i-693. If it doesn't, look for a civil surgeon in your area and ask him/her to complete page 1 and page 5 of the form. Note that you won't need a complete physical, you will only have to have the vaccination record completed. Good luck
