Hi:

We met through a site based on traditional Japanese introductions. It doesn't charge American men but does charge the female Japanese members. They did just start charging American clients.

So I assume they we would answer yes they are an IMBR?

Also- I got in a heated argument with a prior girlfriend about five years ago that led to DV arrest. IT was her word against mine. The woman was later arrested for stalking, but they didn't help after the fact- I had already pleaded nolo-contrendre (sp) based on my attorney's advice.

I have informed my wife to be of the issue- and believe she has to be provided with certified copies of the material in Japanese?

Will this slow the process/or make it impossible to do through the DCF? I am in the process of having the conviction expunged.

If you look closely at the I-130 form used for CR-1 either filed at USCIS or at the embassy (DCF) you may see that there is no IMBRA questions. I don't believe that IMBRA affects spouse visas (CR-1, K-3) only the K-1 Nonimmigrant visa.

More about IMBRA http://www.uscis.gov/files/article/IMBRA072106.pdf (Only mentions K-1, and K-3 visa and states that they do not apply to K-3)

Your best course of action it to marry in Japan, and then file for visa at the Embassy in Japan, (DCF).

IMBRA specifically affects anyone having to file a I-129F petition! A K-3petitioner is not suppose to be affected by the multiple filings provisions like K-1 petitioners.
