Hi msangela,

My I485 status changed to testing and interview last night. Not sure how this work but do they approve I130 after interview? seems like your I130 is not approved yet either. From other forums, I hv seem people who went for interview had their I130 approved. Is there any reason why USCIS is holding up approving our I130? THanks for your help.

10/18/2013 - I-485 case status updated to RFE and the RFE notice mailed out.

I haven't recieved my interview notice.I am assuming it will be sent out in couple of days. I see lot of other people who got their I130 approved within 45-50 days and these cases has priority dates after 8-Sept. I am just wondering why some of us don't have I130 approved? is it country specific ?

I also was advised earlier by few forum members saying, they wont call u for interview until my date is current because there is no point having interview until they have visa numbers available so I am bit confusion with the whole process. please update us on your interview experience next month.

They will call you for interview but not going to issue GC till date become current.

For I-130, It is depends on which location is our file, I and my brother in law filed on same date @ Chicago office, From Chicago, they send his I-130 application to California, he got an approval in 25 days.

From Chicago, they send my file to NBC because I filled as concurrent filling and they are processing so slow.

And I checked on general timeline on this website and few others, whose I-130 sent to California center they got approval within 30-45 days, and

at NBC center no news. I am going to ask my lawyer tomorrow, when they are going to approve I-130, because i heard they will ask when you go to Interview, But I believe in our case they should know, we don't have approval yet.

Thanks Dhp! this really helped and totally makes sense! please update us once you speak to lawyer as I am curious to find out how they deal with people with no I130 approval during interviews. I just got my interview date of 27-Jan which is a week after yours. we will look forward to hearing your interview experience after Jan-21. Good Luck!!!

Hi All concurrent filers,

I need your help in giving feedback on my case.

Here is our story; I met my wife in 7 months ago when I was visiting my family in India. Then, we were in touch via phone and chat until she came to US for her further studies on F1. All this while, we were dating, didn’t hv plans to get married. Since F2A (I am a Permanent resident) cut off dates were current in Sept and time spend together after her arrival, we decided not to wait any longer and got married in Sept (this was 32 days after her arrival in the country). Obviously, our intend to get married changed after her arrival.

Now we have interview here at local office in 3rd of Jan. is it fair say, our decision to getting married triggered due to cut off dates being current in Sept and we wanted to take advantage of that? I am not sure if this question will even come up. I wanted to get your opinion if saying this will hv any negative impact on my case. I wonder if any of the forum members are in this situation. Your inputs will be greatly appreciated.

Second question,

I am aware; the F1 status goes away as soon as your file "status of adjustment" with USCIS and my wife doesn’t necessarily have to be in school. We got her EAD card a month ago. Given above scenario, do u think it make sense to continue school full time. My wife was thinking of taking a break for semester before she decides if she wants to continue with school.

It should not matter how you answer that, as long as you can show documentation that you are living together since then.... essentially proof of valid relationship... anyways we will receive a 2year conditional GC for folks married for less 2 years.

to your Second Question:

Though she can use her EAD and necessarily give up F-1.... having F-1 serves as a backup.

If you do decide to give up F-1, I would suggest to wait until interview is over...make sure I-130 gets approved before she leaves her F-1 status.

No, even after you file for AOS, the underlying non-immigrant status continues as long as you continue to maintain it.

say you go outside the country, if you enter back on F-1 visa you are on F-1 as long as you donot use your Advance Parole.

I know this for sure with regards to H visa, and I would think it applies to F-1 as well.

The advantage of maintaining underlying non-immigrant status is more like a safety net in case something goes wrong with AOS process.... but if everything in your case is genuine, it shouldn't worry too much to forgo F-1 status.

As your interview is tomorrow, you should anyway know in 2 weeks time if they are gonna approve I-130 or not....

You can decide based on that.

Our interview went well but the IO didn't approve us on the spot and he said that he will mail a notice in a week or a month about his decision. Maybe because our PD is not yet current.
