I dont understand the poverty guideline deal, and I'm worried. I have two children who both live with my wife. I live alone.

I make gross yearly around 45000.00. How do you figure out 125% of the povery guideline on that? will we be ok?

I pay child support for my two children to my ex wife, does that count as a household of 3? even though they dont live with me???

do I show my two children on the i-134 even though they dont stay with me but i pay child support?

I really need help with this, My fiancee is waiting for me to send the forms needed

You count the amount of people that live in your household. You make enough income. Go to the uscis website and look up I864 requirement because you will need that for adjustment of status after you are married.

08/12/2015-ROC Approved. Got letter in the mail.

08/29/2015-received new card in the mail.

wow really that is enough income???
i was worried, I dont know what they mean 125%, then just now I read on the internet any children under 21 years of age even if they dont live with you must be counted into your household.
can anyone verify this please???

I really dont know if i put them down on i134 form or what to do.....

Why are you confused?! Are you reviewing the poverty guideline informational sheet for 2013?!

According to the poverty guidelines $45K is enough to support a family of 7 people (if you live in Alaska, a family of 5 & if you live in Hawai'I, a family of 6). With the 2 children added, will this put you over any of the above numbers? If you have not given up your parental rights and/or file for them on your taxes, I would err on the side of caution and include the two children since you are financially supporting them.

Here is the guideline, if you were to consider your two children, your fiancée and yourself: family of 4, you must make $29,437 (Alaska: $36,800; Hawai'i: $33,862).

They are looking for who you will support, how would they not be considered. It's logical to include them.

yes, I dont claim them on my taxes. My ex wife claims them

No matter where the children live or who claims them on their taxes, all minor children are included in the household size. Yes, he needs to list them as dependents on the I-134. His total will be 4, himself, his 2 children plus you. $45k is plenty > http://www.uscis.gov/files/form/i-864p.pdf

How Do I Count Household Size?

Your household size includes yourself and the following individuals, no matter where they live: any spouse, any dependent children under the age of 21, any other dependents listed on your most recent Federal income tax return, all persons being sponsored in this affidavit of support, and any immigrants previously sponsored with a Form I-864 or Form I-864 EZ affidavit of support whom you are still obligated to support.

Thanks for clearing that up Jay Kay.
Also my fiancee is having little trouble with what to send for packet 3 back to Embassy...

I know 4 things for sure

1- DS-230 part 1
2- copy of biologics on passport
3- The Checklist
4- Sighned Apllicant's Statement

She sent me photos of all papers in packet 3 she receieved and we dont see something that says "Applicant Statement"
