RCMP records missing a charge?

Would there be any reason why a charge is not shown on a RCMP report?

11-25-2011 - NOA1 - Applied for K-1 Fiancee Visa for my Canadian love living in Vancouver from Pakistan, sent package to California
04-23-2012 - NOA2 - Application Approved, waiting for interview date.
07-23-2012 - NOA3 - Email from Vancouver consulate that we are receiving letter to send packet 3.
07-23-2012 - NOA3 - Packet 3 - Letter received to submit DS-230 and Checklist to get a interview scheduled.
12-07-2012 - Interview - Received white paper requesting more documents.

04-10-2013 - Sent additional documents via Loomis for Van Consulate.

05-10-2013 - Email stating passport is at Loomis for pick up.

05-13-2013 - Passport returned requesting 1. Police Reports which we have previously submitted 2 times and also stated 2. Administrative Processing.

08-29-2013 - Received letter stating Visa Denied due to Moral Turpitude, Also note that we can apply for wavier I-601

12-31-2013 - Receipt date for I-601 Waiver - Waiting for results.

07-10-2014 - Interview, Visa Approved, Administrative Processing.... waiting....

8-1-2014 - Visa Issued

11-18-2014- flight booked for Fiance

1-2015 -Married, Registered for SSN, Registered for AOS, Work Permit and Advance Parole

10-2015 - AOS interview, approved.

Approximately 4 year journey to get everything done.

 

8-2017- Filed for Green Card - USCIS I-751 Petition (Form CRI-89, Petition to Remove Conditions of Permanent Resident Status )

 

Waiting to hear back on getting a Green Card....

If the person didn't get fingerprints done, it's possible. That's why if you've ever been charged with a crime of any sort, you need to get fingerprints done at the very least. Also some youth crimes would be off the record but may be still required to show up on the police report for immigration.

Also as a note, if your fiance is from Pakistan, they're going to be scrutinized as if they're living/from in Pakistan even if they are now a Canadian citizen

Conditional Discharges also won't show on RCMP checks. That is why they need court records.

If you weren't convicted, it won't show up.

the problem is he was charged and did the community service for it, it didn't show up in the report we are so confused and we also took with us the court proceedings during the interview and for some reason that did not show up =/ maybe they are inaccurate at the RCMP?

we had the fingerprints and all the good stuff done, we waited about 4 months for RCMP to send the reports back. they take their time there.

Honesty being the best policy and all, I'd go back and ask the RCMP why its not present

Look at the court records for that missing charge. Look to see if anything says Conditional discharge. If they gave him community service it is possible once the community service was done it fulfilled his conditions and after 3 yrs it is removed from his record.

The RCMP did not give him inaccurate police report finger prints don't lie. It would show everything that wasn't discharged. That is why you need to have the court records even for the charge that is not showing up, because US Immigration wants all charges even if expunged/pardon/discharged.

if anything is listed as conditional how does that affect the waiver?
