Received I-797-E Request for Evidence. Have a question.

Hi everyone. I just received a request for evidence for my K1 visa. I was wondering if anyone else received a I-797E has had the *All foreign language documents disclamer. I am asking whether ALL I-797E always say the same disclamer listed below?

EDIT: I find myself asking the same question over and over, please look at the attachment for the quesiton at hand =p

On the page that says the request for evidence it says verbatim:

REQUEST FOR EVIDENCE

*All foreign language documents must be submitted with complete word
for word English translations. The translator must certify that the translation is complete and accurate and that he or
she is able to translate. Do no submit the English translation without the foreign language document.

- So the entire reason they are requesting evidence is because a small question whether or not they have been to the United States was accidently ommited or do they want something more?

So my question to you all is whether the part with *Language translation is universal to all 797-E forms of this nature or are they specifically asking that I provide certified translations of forms. I understand all documents that are in another language need to be translated into english and the person doing so must claim they have translated to the best of their ability. This is not the issue. I simply want to know if ALL I-797E forms ask the asterix part, that USCIS isn't specifically asking me to submit certified translations of the documents. I have reason to believe that they are not asking me for that because nowhere in the RFE do they specifically say so and I have heard from others that a certified translation isn't required (an agency or service you must pay money to, to translate each document page by page)

In the past I had already submitted translations for the foreign language portions of the documents and it was signed by the translator but it was through my fiance not through some agency with a fee, stamp and translator number.

Should I answer the RFE by getting a certified translation for all documents (they did not mention for the RFE) for fiance's birth certificate and such and resubmitting the entire 129F or is turning in #question of page x(by itself) circled in red I-129F sufficient? Thanks I would appreciate a straight forward answer or anyone with personal experience with a I-797E whether you received one that had the same Foreign Language disclamer even though you did not need to submit any translation for your RFE.

Muse, all foreign language documents (non-English) must be translated by a certified translator of the respective country and all translations must include the statement that the translator is competent to translate.

The paragraph with the asterisk about translation is just general guideline/instruction, or in your words, its universal.

Yes, the entire reason for the RFE is because of the unanswered question whether or not you have been to the United States. Just answer it and send it back and you should get your NOA2 soon. At least its something easy

Here are copies of other people's RFEs.

1. This RFE was last year, it is about the couple not submitting enough proof that they have met within 2 years of filing. The translation guideline was also appearing on top.

2. He/she was issued an RFE because of the passport photos they submitted, but the translation guideline etc (the paragraphs with asterisk are on top too). This rfe is a little old so the guidelines now are updated/different.

Thank you all for the swift reply. I had tried asking Immigration attorney and even upper level USCIS (waited an hour on the phone just to talk to them) and they never directly answered the question. =p

So should I turn in the page with all the information refilled out for the I-129F for the page in question completely or just the question they asked for leaving the rest of the fields blank since they already have that information?

*Will send it in soon, just crossing my fingers that there will be no more RFEs after this, (they wouldn't simply stop and ask for this but have looked at all of it and sent all RFEs in one I-797E correct?

Do you suggest I get a certified translation just in case? My documents were translation by my bilingual fiance. I read in this forum that a certified translator (though an agency is not actually acquired) but it may be the case that some individuals have just squeaked by without one, but generally USCIS wants a certified translator that has a certification number and a stamp of approval?

just answer what was encircled. not really a good idea to volunteer more information than what was asked. you're setting yourself up for another probable rfe. if they wanted the certified translation, they will ask you for it.
