Can My USC Parent Sponser My Spouse?

I'm a USC and filed my I-130 for my Romanian husband this year. While the end doesn't appear anywhere in sight at this point, I'm trying to get prepared for the next step. I am having some difficulty finding out the answer to a question I have about the affidavit of support.

I *do not* have a job right now, I'm a stay at home mom, currently living with my parents in the US. My dad is well above whatever poverty guidelines are required, and he is willing and ready to sponser my husband and take responsibility for him.

So my question is, how do we do the affidavit of support? Am I required to fill one out, even if I am unemployed? how does that work?

Thanks in advance. I figure you guys are some of the best to come to with questions, it so much better to hear it from those with personal experience and I appreciate your time so much! Hoping to figure this out!

Read the Instructions for Form I-864.

You as the Petitioner/Sponsor is required to file an I-864 even if you have no income. You will be the primary responsible for your husband on the I-864 obligations.

Your father would be the Joint Sponsor. He files his own I-864. Essentially, he is like a co-signer on a loan. He is secondarily responsible for your husband on the I-864 obligations.

Yes your father can be your joint sponsor. Both of you would complete and I-864. If your mom also works and they file their taxes as "married filing jointly" she should complete an I-864A to supplement your father's I-864.
