I worked throughout my 1 year OPT visa upon graduating from graduate college. I also had a H-1 for 6 years previously, before I went to graduate school. Do these qualify to waive the affidavit of support from my US citizen sponsoring spouse?

This is posted on USCIS website but I'm not sure what does "40 qualifying quarters/credits of work" mean.

When NOT to Submit an Affidavit of Support

The following types of people do not need to file an affidavit of support:

  • An individual who has earned or can be credited with 40 qualifying quarters (credits) of work in the United States

40 qualifying quarters basically means 10 years. Maybe someone else can chime in with more information.

What about the financial support proof? USCIS states that

"The total net value of assets, less liens and liabilities against them, must equal five times the difference between the sponsor's income and 125% of the poverty level for the household size"

125% of poverty level $15,510 for household of 2 = $19,387.5

If my sponsor's income is about $70,000 annually, the difference between income and 125% of poverty level for household size of two equates to $50,612.5

The total net assets must be 5 times of $50,612.5 = $253,060

Did I do this calc right? Is this financial amount strictly required for all spousal sponsorships? Otherwise we will be denied? What if I have strong qualifications and work experience and will get a stable income job once I get my EAD?

My spouse will be the only sponsor at the moment.

I looked up more info about the income requirement and found this - If the sponsor’s income meets the minimum Federal poverty guideline income requirement other assets generally need not be presented. However, the consular officer may request evidence of assets and liabilities, as necessary to determine eligibility.

My spouse's income should be at least 125 percent of the current Federal poverty guideline for our household size of 2.

125% of poverty level $15,510 for household of 2 = $19,387.5

Suppose my sponsor's income is about $70,000 annually, that passes the requirement. There is no need to worry about the total net assets.

Correct?
