Hi ,My name is Kimberly and I have a question about the income guidelines for affidavit of support. I had a case with uscis and now it is forwarded to the NVC for processing and transfer to the Kingston embassy. My case is for a 129 F fiance visa. He is bringing his 2 kids and I have listed them on the petition as well. I’m trying to figure out if I go off the income guidelines for my household size now which is 2 ( me and my daughter ) or should I go off of the guidelines for a family of 5 which includes me, my daughter and my fiance and his 2 kids. I’m just trying to figure out the income guidelines I need to meet. For a family of 2 it's $15,510 and for a family of 5 it's $27,570 for form I134 . Also do anyone know how long it takes for the NVC to receive the I129 petition for fiance after it is approved. I called and they still have not received it as yet. They approved it on Sept 11th and sent me a notice saying that they sent it to the NVC. Thanks in advance.

If the visa is approved and your fiancé arrives, after you get married you have to adjust status and you will submit the affidavit of support Form I-864 (along with all the others) and that requires 125% of poverty level.

When you guys say i need a sponsor don't this apply to the I864 when he arrive in the states because i thought your not able to use it a sponser on just the I134 . You will only be able to use a sponser after the fiance is here. I'm so confused

Our embassy uses the 125% guidelines that is listed on the I-864P. You will need to meet the guidelines of a family of 5. If you don't meet the guidelines, then you need a co-sponsor. They accept co-sponsors at our embassy for a K-1.

Ok thanks for your help. This make me feel a bit better because i started to cry. I just want my baby to come home. He's having a hard time in Jamaica with his our kids (my step kids) . He is a single father there and his baby mother does not do anything for her children. Just want them here so they can be taken care of.
