Applying for Advance Parole after receiving EAD?

Hi everyone,

After entering on a K1 Visa, I applied for AOS and EAD in June, but did not apply for Advance Parole.

I looked at the (national) average timelines and thought it was more than likely that my AOS would completed before I would need to travel.

But I just realized that these average processing times vary greatly from a state to another, and it seems that NYC takes much longer that what I had planned.

I already did the biometrics and received my EAD but don't have an interview date for AOS yet.

Is there any way to apply for AP at this stage, without starting from scratch (paying the fee, biometrics, waiting a few months...)?

My wife and I would like to visit my family in December. I would like to make sure I will be allowed to leave by then, whether with AOS complete or AP.

Any advice is welcome!

Hey there

I applied for AP after applying for AOS and EAD and it got approved within days.....just go ahead and submit the relevant forms along with a copy of your I-485 receipt and you won't have to pay anything for it. You'll get it pretty quickly.

If only the EAD were as quick!!

Yes, you certainly can. You need to fill out the I - 131 with supporting evidence and attach a copy of your I - 797 Notico of Action that shows that you're in the AOS process and that you already payed all the fees, this info can also be found under the I - 485 instructions!!

10/04/13 [Day 24] NOA hardcopy I-130, I-485, I-765

10/15/13 [Day 35] Biometric appointment successful (Idaho Falls ladies were really really nice)

AP is free so there is no fee to pay. You will apply based on being a I-485 applicant. Include a copy of your NOA1 from the I-485. AP doesn't require biometrics.

AP is free so there is no fee to pay. You will apply based on being a I-485 applicant. Include a copy of your NOA1 from the I-485. AP doesn't require biometrics.

Hey guys!

I'm working on applying for AP after already having received the EAD for my wife and I was just curious... Do they send you a whole new combo card?

Is the Form I-797C, Notice of Action all I need to send in a copy of with this application?

I also noticed that on the I-131 they ask to explain how my wife qualifies for AP and what circumstances warrant issuance, to include copies of documents. Is this a big deal? They make it sound really serious. Her brother's wedding is this summer and the way AOS processing is going, we figured better safe than sorry.

Also in regards to this, any advice on whether to check one trip or more than one trip? Does it really matter?

Hello guys,

Your responses have been helpful, however I would just like to clarify one thing:

My situation is similar to some of the replies above:

Canadian citizen entered with Canadian passport with K1 Visa

Applied for AOS and EAD, received EAD

And now I want to apply for AP since we have a date planned for travel, on a cruise to Mexico

My question is: after applying for Advance Parole, and if approved, do I use my Canadian passport to enter Mexico, and then the Advance Parole to re-enter the US?

Or will the cruise line take care of all the immigration stuff? Do I need to apply for a Mexican visa? Afaik Canadians can freely visit Mexico and I've done so with a Canadian passport

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
