please guys help me my husband is in the hospital i need help! can i avail emergency visa? so that i can take care of him in the hospital, we filed on december 2012 and still waiting for noa2.. please advice!!

There is no such thing as an "emergency visa" for any situation. The petitioner can request an expedite but the is no guarantee at the request would be granted.

September 2007: Met online via social networking site (MySpace); began exchanging messages.
March 26, 2009: We become a couple!
September 10, 2009: Arrived for first meeting in-person!
June 17, 2010: Arrived for second in-person meeting and start of travel together to other areas of China!
June 21, 2010: Engaged!!!
September 1, 2010: Switched course from K1 to CR-1
December 8, 2010: Wedding date set; it will be on February 18, 2011!
February 9, 2011: Depart for China
February 11, 2011: Registered for marriage in Wuhan, officially married!!!
February 18, 2011: Wedding ceremony in Shiyan!!!
April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Sis, tell your husband to call the uscis and request for expedite service to expedite your case. I am CR-1 visa filed April 2013, National Benefits Center and still waiting for NOA2 but my husband called the uscis the other day and ask if there's any way to get me quick coz he has some health reasons as he mentions then the officer told him that they're going to put our case to request for expedite service due to health reasons and not to call them back til oct. 2, if we cannot receive the notice and the receipt number by the fist of Oct, so hopefully.. try to ask your husband to call the uscis and request for expedite. by the way, add me at fb sis Irish Slotnick so we could talk sometime.

He is in hospital, he has hundreds of nurses checking on him. Keep in mind even with an expedite, it will take several weeks at least to get the visa. YOu need to gather evidence why you need to be with him after he comes home from hospital.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

please let me know what are that evidence? if we expedite it do we get our noa2 also if the expedite request granted.. i know its a lot nurses there but its also good if im there with him so that if he needs something or i can just stay with him in the hospital..

Yes it would be nice for you to be with your husband in the hospital, and when he gets home. But "would be nice" is not grounds for expedite. You need letters from doctors, the more the better, stating that he will suffer significantly if you are not there, and why it is medically necessary for you to be there. Ie why can't friends and family look after him? What about his insurance paying for a rehab facility rather than you coming over faster? This is NOT an easy expedite to get.

so let me know how to get expedite interview? is my husband need to call uscis to have the expedite interview? if he will make a note that he need me because his parents is in homeland and his sister dont have time to look after him because she is busy working and to look his mother too and nobody cant look after him, do he need a note to expedite? or just the doctor letters?

That statement means: it is NOT a good reason or one of the stated criteria for granting expedites.

Simply put, husband in the hospital with available professional care and other family members present is NOT enough justifiable reason for uscis to hurry your case ahead of others in line.

If expedites were that simple and easy to come by, then everyone one will go for it and there won't be any need for a line. That said, I wish your husband a speedy recovery. And if you decide to go for the expedite you get it.

Expedite Criteria

All expedite requests are reviewed on a case-by-case basis, and are granted at the discretion of the Director. The burden is on the applicant or petitioner to demonstrate that one or more of the expedite criteria have been met. The criteria are as follows:

  • Severe financial loss to company or individual
  • Extreme emergent situation
  • Humanitarian situation
  • Nonprofit status of requesting organization in furtherance of the cultural and social interests of the United States
  • Department of Defense or National Interest Situation (Note: Request must come from official United States Government entity and state that delay will be detrimental to our Government)
  • USCIS error
  • Compelling interest of USCIS

Note: Discretionary expedite requests for petitions and applications that have Premium Processing Service available will not be considered for expedite processing. The only exception is when the petitioner is a not-for-profit organization designated by the Internal Revenue Service. For information regarding premium processing, please refer to the premium processing webpage.

If you have already filed your application or petition:

You can make an expedite request by contacting the National Customer Service Center (NCSC) at 1-800-375-5283. The NCSC will take a “service request” and forward your expedite request to the office with jurisdiction over the application or petition. You also have the options of 1). visiting your local office by scheduling an InfoPass appointment or 2). writing a letter to the local office or service center.

You can expedite....I don't think there is anything as such because if you apply for visiting visa, you may not be able to got approval because of your immigration intent. Though you are at the 8 month mark...putting an expedition will cause them to work on your petition. And they good news is that you can expedite all the way to your interview.
