I am holding F-1 visa and I married US citizen.

I have already sent form I-130,I485 for AOS, and I just got NOA for both last week.

I would like to know about my status now.

Am I still f-1 student?

Do I need to maintenance my visa?

Do I need to tell my counselor about my status?

I was in the same situation as you, you should inform your International Office... and later when you get your GC they'll need a copy of it also. I don't remember exactly but I think they still kept me in their database nonetheless as an international student until they got a copy of the actual GC.

Also in my case I had gotten the F-1 while in the US, and the form didn't have a stamp on it, so I just chose to get the "advanced parole for travel" when travelling while waiting for the CG.

When coming back into the country, I went to the non-US citizen line by habit, and when I get at the end they told me I should have been in the US citizens/permanent residents line all along, so I guess USCIS pools residents and applicants together, at least in terms of going thru immigration..

I would say that you'd better continue studying. First, you need your degree. Second, when you have your AOS interview, they will be willing to see that you came here to study and not to marry.

Your current status sounds something like "adjustment of status pending" :)

You may tell your counselor about that, but in my case it did not change anything. You still do not qualify for resident tuition. :angry:

When you get the actual green card it may be a different story.

Your F-1 status is effectively cancelled by filing AOS. However I believe you can still be a student, just don't try to travel using your F-1. It's probably best to talk to your International Students office about you filing AOS.

My husband was an F1 too. At the interview the officer crossed out his F1 visa and told him that he is no longer an F1, but a "pending adjustment applicant." He told my husband that at the point he sent his AOS papers in, he ceased being an F1 since F1s must not be "intending immigrants."

The international office will want to know about your change in status -- send them a copy of the NOA1 (and PR card when you get it) with a notice _in writing_ that you are changing your status.

If you changed your name, you'll need to notify the university of this as well.

Are you on OPT? IF so I hope your card doesn't expire soon. If it does, you'll need to submit an EAD application ASAP. They are taking over 90 days to process nowadays.

Remember, an "adjustment of status pending" status which you have now, does not permit you to work in US. You would have to get EAD for that.

If you already have an EAD (for example, OPT for F-1 status will provide you with EAD) then you're authorized to work as part of your academic program until the expiration date of the OPT EAD.

I don't believe OPT becomes invalid after you file for AOS, although there is some argument over this.

You're right, Dr_lha. You are free to take classes for as long as you wish, no matter if you're an F-1 or AOS pending. Studying is not illegal for "AOS pending" :)

In my case, I will continue study, but I just wonder if I can study part-time since my F-1 no longer valid.

Or I need to do exactly the same thing when I was F-1.
