skip biometrics?

Suppose someone is removing conditions and submitted the paperwork,

received the NOA but failed to turn up at the biometrics appointment.

What will happen then? Will this person just live on normal life

with the extended card for a year, and then they will issue the

deportation order? Or will they be sending additional messages,

inviting to biometrics, or something about the case being dropped?

I am asking just for the research.

Just a guess: they will send you a second biometrics letter, assuming the first one got lost...

May 27th, 2003 NOA1

November 25th, 2003 NOA2

December 4th, 2003 received Packet 3

December 25th, 2003 send Packet 3 back to the US Consulate in Ho Chi Minh City.

April 6th, 2004 Interview for K-1 visa.

April 6th, 2004 Got K-1 visa. Phew!

June 1st, 2004 Wedding in Vietnam.

June 4th, headed back to the USA.

June 26th, went to Old Courthouse of Santa Ana (CA) to get marriage license.

July 14th, 2004 received certified copy of marriage license.

-I-485, I-765:

July 20th, 2004 mailed AOS, EAD to SA Sub Office, CA.

July 22th, AOS package arrived at SA Sub Office.

Sept. 23th, fingerprint and biometrics (appointment letter with receipt).

Sept. 24th, EAD obtained.

Feb. 22nd, 2005, AOS interview (approuvé ,I-551 stamp)

March 4th, 2005, "Welcome to the USA" letter. (NOA)

March 7th, 2005, received REAL green card (3/4 pic)

AOS interview experience @ SA Sub Office

I don't think they would send a second biometrics letter assuming the first get lost. Letters from them seem to get lost regularly, but they don't accept that as an excuse if a notice or benefit from them has gone missing in the mail and basically tell such unfortunates that they have to re-apply for the benefit i.e. green card - and pay the fee again. I don't think I would like to play such a dangerous game as not responding to a biometrics appointment letter. If, for some reason, I missed the appointment, I would call them up right away and see about rescheduling.

G's biometrics letter says "IF YOU FAIL TO APPEAR AS SCHEDULED, YOUR APPLICATION WILL BE CONSIDERED ABANDONED." Or in other words, they'd cancel your pending I-751 and you'd have to re-file it, plus (if your green card has already expired) you'd be out of status and could be put into rescission/removal proceedings.

do you mean that NOA only functions along with the removal of

conditions procedure and can't be used as a valid substitute for a

GC in its own right?

The NOA is only to cover you while they Process your removal of conditions.... it is not valid in its own right.... if you failed to show up for your biometrics they will consider you have abandoned your case and you will no longer be a LPR... not a wise move...

As pointed out on here - the notice states what will happen, but the info is incomplete.

We just got our noa-2 biometrics notice today, so this is fresh in my mind. It said if you miss the appt, you can show up any wednesday afterward, at the same time (9am for us), but only up to a certain date. For us, the appt is this week, the cut off date is sometime in Feb 2007. After that date, the app will be considered abandoned and status revoked.

So, you can miss the original appointment, but you have to get it done within a certain period of time, or else.

PEOPLE: READ THE APPLICATION FORM INSTRUCTIONS!!!! They have a lot of good information in them! Most of the questions I see on VJ are clearly addressed by the form instructions. Give them a read!! If you are unable to understand the form instructions, I highly recommend hiring someone who does to help you with the process. Our process, from K-1 to Citizenship and U.S. Passport is completed. Good luck with your process.

I think that depends on the ASC, actually. I've heard of that before from other people, but G's specifically said that he could only come on a Wednesday if he called or wrote before the scheduled appointment to say so, and that if he hadn't called or written before the appointment, the application would be considered abandoned.

So there's another tidbit of info for sen: there's no way any of us can know for sure what USCIS will do unless someone else lives in the area served by *your* ASC.

Not on your Service Center, on your Application Support Center, the place that does biometrics.

There are hundreds of them, there are more ASCs than there are District Offices, and so the only way to know what would happen to YOU is if someone answers who went through YOUR Application Support Center.

Thank you all for replying.

And, again, asking hypothetically:

1. Will they send a note that the case was abandoned because the

person did not show on the biometrics?

2. How soon such a note would arrive (say, in a month after the

appointment was missed, two three? I include the period when they say

to come the same day). What will it say: your case is abandoned, you

are under deportation orders? Or: the case was abandoned you must

leave the country?

3. Can one reapply anew?

4. And, if one just stays in the country for some time, and then

leaves, and then comes again, what one is to say in the form, they

have this question when you fill "Have you ever been deported from the

USA?" Would this person be considered deported or deported it's when

they send you out in handcuffs with policemen?

My NOA makes no mention of that. Just states if you do not show up, its considered abandoned.

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1
