Hello,

If there is an error in my I-751 application will the reviewing agent let me knoe emmediately? Ive read that the Vermont service center is behind 3 weeks. Im about a month away from the deadline for my wifes green card. So im worred that if there is an error I may not get it back to them in time.

First relax and realize that your wife's GC is going to expire before you get the new one. That is okay as the NOA1 is a 1 year extension of the GC and can be used for travel and employment. My wife's GC expired in May and we filed the end of February. She did not recieve the 10 year GC until the end of June. So her GC was expired 1 month, but we ahd the extension letter. The only time to panic is if the extension letter is about to expire and still no GC. Do you file for citizenship or renew the GC?

Not clear what your specific issue is about.

USCIS first checks if the is paid and if the application is filled correctly and issues NOA1 and then get the Biometric scheduling. Sometime later, may be after the background checks were successful, they will review the evidence.

Also once you submit the application with what ever evidence you have, first you will get the extension of the GC by an year, Then you can always submit additional evidence along with a copy of your NOA.

If there is an error with any evidence, you will get a RFE either seeking clarification or additional evidence.

09/12/13 - Case transferred to CSC. NOA2 received on 09/18/13

08/30/13 - Biometrics Done - No walk ins allowed at this LSC (received on 8/16/13).

08/05/13 - NOA1 (received on 08/10/13)

08/01/13 - Mailed I-751 (received on 8/2/13 - check cashed on 8/5/13)

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)
11/28/11 - Received Green Card (Expires on 10/30/13) - Welcome Letter on 11/17/11
10/30/11 - POE - Houston, TX

Chennai Consulate (40 days)
10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.

Hi Dave. Thank you for the reply. We are applying for removal of conditions. Her two year green card expires October 20. So we are too close to the deadline. There should be no problems. But for some reason I they send the I-751 back because it is not correct I just want to make sure I will be able to correct and resend.

As long as it arrives BEFORE her green card expires, October 20, there is no issue at all. If you feel it will NOT arrive before then for some reason, then simply attach an explanation of why it is late and ask to be excused for sending it late. Nothing to worry about.

I have no idea what you mean when you say "the Vermont Service Center is 3 weeks behind" If you mean sending out NOA1 notices, that is not an issue.

ALWAYS send anything to USCIS with delivery confirmation, regular USPS with delivery confirmation is fine. It is not necessary to have a return receipt or send it by Fedex to get delivery confirmation

ONLY if there is no signature or payment. Otherwise you would get an RFE later. If there is no signature or payment they will return the petition to you and you will correct the problem and send it back. IT WILL NOT MATTER that it is then late. Simply attach an explanation letter.

No one cuts off your fingers or toes if you are late. I know several cases where the petition was sent 1-2 months late, an explanation was attached and the petitioner still got their extension letter.

You can move on to worrying about something else
