Can we move to the US while we wait on approval?

There are so many different opinions flying around.... Do what you feel is right. The K-3 still exists.

My attorney advised me to file the K-3 (sent by fed-ex yesterday) because they have extended the I-130 processing times. He believes the K-3 is a good choice. And no, it didn't cost me one extra penny to file. The lawyer was paid a flat fee. He's not making anything extra

The I-130 spousal visa requires 1 process.

The K-3 and AOS are 2 processes with their own fees.

While your lawyer may charge a flat fee for either process, the US government does not. The combine fees for the K-3 and AOS is higher than the spousal immigrant visa.

The OP can pursue both the K-3 and I-130 spousal immigrant visa.

However, with 4 months already invested in the spousal visa, the K-3 petition filed now would be shelved once the spousal immigration reaches the US Embassy.

At this point, it's a matter of timing. 4 months already invested in an immigration visa vs. a K-3 files now.
