Hello everyone,

My waiver was received by Nebraska on July 17, 2013. My waiver is for unlawful presence for more than 1 year. There are two things that are starting to worry me: When I was 17 I got arrested for vandalism, shooting paintballs at a friend's house, but the family didn't press any charges. I didn't have to go to court or anything. On Dec. 2008 I was involved in a hit and run accident. I struck a crossing sign and left my car there. The next day I went to the police station looking for my car, a police officer took my statement and told me I would need to go to court. When I went to court I was charged with a hit and run, I didn't have a criminal record so the judge said all I needed to do was pay the city for the damage to the crossing sign ($250) and the case was dismissed by the DA and judge. In essence, I have never been convicted of any crimes but I know for the waiver any type of run ins with the law can have a negative affect. My lawyer said that these two incidents should not affect my waiver decision but that they might send an RFE for the court records and police records. At the visa interview they asked me about these two events and to tell them what happened and that was it. Then they said I was ineligible for a visa for my unlawful presence time. Should I be worried about these events? Anyone out there with a case similar to mine? Thank you for your time.
