Hi

Please can I file tourist visa for my husband while waiting to get my citizen ind next 3yrs before I can petition him and if I do is it going to be a problem when I file k-3 for him , am so new at this but we are getting married next year and I dnt want us to be apart till wen I get my citizen . If so which form do we use nd which category .

no. you cannot file a tourist visa for him.

OTOH, HE can file for a tourist visa.

Green card holders can file i-130 for their spouses but your spouse will have to wait in his home country for the visa.

If you're planning in using a tourist visa so he can permanently stay in the US, then that's immigration fraud. Tourist visa is for visiting only with no immigrant intent.

Your husband will have to apply for the tourist visa himself. You cannot file or sponsor him for a tourist visa.

From Nigeria, his chances of receiving a B-2 whilst being the husband of a US citizen or LPR are essentially nil.

In addition, the K-3 is an obsolete visa that is very rarely granted anymore.

Most of our now spouses at some point filed for a visitor's visa and were denied. Nigeria is one of the most difficult counties to get a visa from "period". Your husband/fiance will need to provide financial and family ties that would convince the CO that he has more to go back to Nigeria for than to stay in the USA once here. Unless your soon to be husband has properties, investments and etc. the chances of him getting a visitor's visa is probably close to none.

Anyway, you would want to be careful that you don't fall prey to the so called experts in Nigeria who will offer their assistance to fill out the forms for you who will add stuff in your application which might cause you more harm down the road than good when you file for your hubby. I had a friend who's fiance at the time asked one of these experts help him out with the forms and he put down that he was married and had a wife to come back to. They did not give him a visa and when the time came he was denied his fiance visa due to this surfacing in his profile.

Be very careful as you proceed. Make sure you are truthful and honest and follow the laws to the T. Anything you do which is not hmmmm legal could and will come back to bite you in the long run. VJ had a lot of information to assist you to do this the right way. Please read and learn and then proceed. As suggested you can file for your husband with a GC of your own and you can file for CR1 once married. Good luck!

@apple21 am trying to find a way he can be visiting nd going back till I can file for him I know I can file wt green card but its gonna take 5yrs longer than my getting citizen . So is there no other way he can visit before then . Wat about studying here we can pay the tuition nd he can do his degree here if its not gonna affect us wen we file. Thanks guys so much I really want everything legal dats wy am asking vj. Dnt wana make a mistake thanks again
