Hello All,

I have a couple questions regarding form I-751. Do I include my information in part 3: Information about the petitioning spouse......... Or is this space for a spouse who is also applying for lifting of conditions.

My other question is regarding part 4: information about your children. My stepson is using our address as his address, however he is living with friends for the past few months. We receive all his mail. Since he does not have a permanent home what should I use for his address. And for the question: Is the child living with you? Do I mark "yes" or "no"?

Ok, one more question. Can I leave spaces blank, or do I need to write None or N/A?

Part 4 is information about YOU. Part 3 is more information about your WIFE. In this case your WIFE is the petitioner, not YOU. You are a JOINT petitioner

For your stepson, asnwer truthfully. There is no requirement that he live with you. He MUST be living in the United States (residency) though he could even be overseas for certain reasons in order to be eligible to also remove conditions. If his official address is your address, then so state. If he does not sleep under your roof, then so state. It makes no difference to your wife or him.

As for leaving questions blank...depends on the question. If it is filling in a field with information about children and you have no children, or only one,then YES you can leave it blank.

Remember that you must list ALL children, even your own, even children that are adults and not living with you. Note that they als ask for immigration status. If YOU have a 30 year old son living in California from a previous marriage, list his name, address and immigration status as "US Citizen"

Hi Gary. Thanks for the response and help. I have 30 days before our deadline to have I-750 submitted. Ive been waiting on my step-sons legal/court paperwork. However he is still trying to pay hus fines. My question is if the agent reviewing my docs sees an issue or something incomplete, will I be able to resubmit after the due date?

Fill in US Citizens details in Part 3.

If I were you, I would use my address for my child in Part 4. If you use your address, the answer to "Is child living with you" is YES else "NO".

You can leave the spaces blank.

11/28/11 - Received Green Card (Expires on 10/30/13) - Welcome Letter on 11/17/11
10/30/11 - POE - Houston, TX

Chennai Consulate (40 days)
10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.

Send the papers before the due date (Oct 20)

If you do not have your stepsons court records you will get an RFE for them, it will not affect your wife's petition or removal of conditions. DO NOT wait to file the petition beyond the expiration date because of missing paperwork from your stepson, file it and let them send an RFE

The only things that cause a rejection and re-submission are lack of payment or signatures or lack of necessary forms...such as you do not send the I-751. Other missing documents will be handled with an RFE just like they are for other processes.
