I am on H1B visa which expires in Oct 2014.

I am getting married to a green card holder in November 2013.

I want to know how soon will I get my EAD after marriage?

With the EAD, will I be free to work anywhere else/ on my own?

Depends on processing times and whether or not the PD for F2A is still current when you file, or not.

The priority date for F2A retrogressed in October and may well again for November.

Hi,

First your employer must me ready to file for EAD. You can check the processing times of EAD in USCIS Website.

Why should the employer be ready to file for EAD? The OP wants to know how long would the EAD that he would apply for along with his I-485 take to be processed.

Varun, Congratulations on your marriage.

As hypnos mentioned, the priority date for F2A has regressed and is now cut of at September 2013 as per the October visa bulletin.

How this affects you is that you will not be able to file I-485 (or the EAD) till the date is current. Spouses of LPRs can not file I-130 and I-485 concurrently (unless the PD for F2A is current).

After you get married, you should file I-130 and that will get you a priority date. Once that priority date gets current, you can file I-485 and for the EAD. Right now, the processing time for EAD is about 3 months. So approximately 3 months AFTER you file you I-485.

I would suggest you apply for H1B renewal as well (I think that is in early 2014) just to be safe. Overstay is not exempted for beneficiaries of LPRs.

Also, yes, with the EAD you will be able to work anywhere (but if you use your EAD for employment, your H1B will be automatically canceled). Only getting an EAD does not affect your H1B status but actually using it does.

  • If you can file and have it received in September, then you can file I-130 and I-485 (and I-765 and I-131) concurrently. And you can get EAD/AP in three months of filing.

Otherwise, you just file I-130 and wait for it to be both approved and the priority date to be current (by the time it's approved the priority date will probably be current or close to it), then file I-485 (and I-765 and I-131). Again, you can get EAD/AP in three months of filing.
