This is such a sad post. I don't believe there are words to describe how awful this situation must truly be. I agree with Rebeccajo in that there has to be an explanation for why he was totally banned. I've often wondered what I would do if my husband was denied entry for some reason, I know what I say I would do, but if the time should ever come does any of us know what we would really do?

I've often wondered what I would do if my husband was denied entry for some reason, I know what I say I would do, but if the time should ever come does any of us know what we would really do?

Well there are several reasons for visa ineligibility and they are posted in the information guides on both the State department website and the consulate websites. (http://travel.state.gov/visa/frvi/ineligibilities/ineligibilities_1364.html) So people who have a reason to potentially be denied, *usually* are aware of it before the interview, and are prepared to file a waiver of ineligibility and hardship letter and wait out the process.

In this case, while we may never know, I assume something came out at the interview that was completely unknown in advance and therefore this is an enormous shock.

In any event, wishing the OP the best of luck on an appeal.

I can't say much without details, but i've been waiting since July 2005 and my husband's visa was denied in February 2006. I was broken-hearted, but that's the process, it's not all that good. We're still working on even getting answers from anybody...

And I have the US Senator and Congress Woman's offices involved in this too...

So, yeah. In order for anybody to help you out you need to give more details.

Good luck and don't feel too bad, there's lots of people that's been happening to (or something similar).

I know some people who's been waiting for 3 years, getting to the 18 months soon myself.

Got married - May 2005

Filed I-130 - July 2005

Filed I-129 - August 2005

Interview - February 2006 - 221(g) - still under investigation.

Another useless interview - July 2006 - got nowhere!

He was denied his CR-1 and they would not allow him a waiver, and put a permanent ban on him from ever coming into the USA.

I am shattered and fallen ill, he is numb. We do not know where to go or what to do...

I can not move to the UK, if I did I would have to leave my first and only 12 year old daughter, seperating her form her only younger brother and also leave my mother who is ill from a brain tumour. There are so many other factors involved to as why I can not move.

We are all lost, where do we go now...

I am so sorry to hear about your fate... don't worry, God knows what is better for the both you... keep praying.... and don't lose hope.

To everyone who has responded and taken the time to read about our denial, thank you... from the depth of my soul, thank you for caring...

I am ill beyond anything I have ever known, I can not eat, I can not sleep normally, I cry spontaneously... I am struggling terribly at the moment.

We are going to find an immigration lawyer and do our best to fight this. I am sorry that I can not give out anymore details of what happened.

I am living in more pain than anyone can fathom or write in a hardship letter, this is something I never thought was possible. I am truely bound and bonded to my husband legally, spiritually, mentally, and physically.

...and we are torn apart by the immigration system.

I am really sorry to hear that. My husband was issued a "sort denial" as other members of VJ have informed me about. I wish I was knowledgable enuff about this to where I could give u some advice. The attorney sounds like the best thing for you, tho. I have one waiting in the wings just incase there is an issus e with my husbands CR-1.

I feel u and how devatating it is. The difference between u and myself, is that my husband wasn't banned. This is the first time I have ever heard of someone being "BANNED". I never thought about that possibility and again I am truy sorry for u and your husband.

There have been restless nights for me too. But again I am not technically in the same boat as you are.

Has your husband ever applied for a visa before? As long as you have some idea as to why the decision was made.......

I am so sorry to hear about this happening to you guys. Respecting your privacy, I can only tell you what other members have said - consult with an immigration lawyer and keep your faith strong. Wish I had more wisdom to share with you. Perhaps living in a third country is a possibility; although I am sure this ban may weigh heavily on any third country to issue an IV?

Andy, summer pm.d you as I was so shocked to read this and my heart goes out to you both.

What ever the reason for the total denial was it will be understood on here if it is too personal to post,if you do decide to post I am sure that if anyone feels they may be able to offer you even a crumb of advice that may help you, they will, there are after all a lot of good people on here. :thumbs:

In the event that you do not, an immigration lawyer is your best option I think

Summer, you've never posted here actively much. I did note your post a few days ago about filing hardship letters. From the nearness of the date of the post to Andy's interview, it appeared to me you were caught unawares by something - perhaps simply the knowledge that filing a waiver was required.

Sure there are people on this board who are nosy and you probably don't want to reveal too much. But there is help here if you want it. Not to mention the fact that your situation/story could help someone else.

We really don't know what to say to you other than we are sorry. Perhaps that is all you need from us at this time.

the denial is possible for everyone, there could be millions of explanations for a visa denial but a ban forever, there should be too many reasons for that. What could result in a ban for all life? I know that if you violate immigrations laws, such as overstaying , working under tourist , student visa etc.., gives you 3 or 10 years ban. but even in these you can file a waiver. Well the reason should be one of the sections on Ds 230 Part II. Most people doesnt have to answer those but I believe they apply to everyone. Some of the sections should get to file a waiver but some of them definitely would result in ban for all life.

I've been thinking about this as I was driving this afternoon.

This situation should be a good lesson to all of us.

I see everyday on this board people saying 'you don't need an attorney'. I've been guilty of saying the same myself but I got smart a while back and quit dispensing that advice.

I mentioned earlier that Summer just recently posted about hardship letters. When I had seen that post I was alarmed - even though she's not a frequent poster I knew they had filed some time back and that the process must be nearing fruition. I then noted in her timeline that his interview was imminent. My immediate reaction was 'are they prepared to go to interview as fully as they probably need to be?"

We never know what the personal stories of people are. It's flip and irresponsible to say "you don't need an attorney". Maybe if Summer had been here more often she might have read some things that would have triggered more research on her part. She and her husband might have sought legal help.

Or she might have listened to those who carelessly said "you don't need an attorney". Personally, it's a phrase I don't use anymore.

The thing is: she needs to tell us why he was banned and the reasons that the embassy provided to her husband for the ban. something must have gone wrong seriously bad, or god forbid, her husband wasn't able to fulfil the visa requirements mentioned in a travel.gov site i saw last night but can't remember exactly right now. Of course it would be great if she reveals a thing or two about it to us and not to mention doing so will help me a newbie a lot too.

Again, I seriously don't want an incident similar to this to happen to even my arch enemy, if there is any.

While I feel bad for summer, hey, she is not in a position to share the reasons. Respect that, it is not always about what she can do for someone else. Maybe she just needed to talk as many of us do here on VJ. Wish her well, offer anything constructive advice you can and hope for the best for her. Most people have some type of past that may affect the process. We all hope and pray it doesn't happen to us but know there is an arbitrariness ( if this is a word) to the process. Good luck Summer.

i understand how you're feeling right now, but please try to get yourself something good to eat and get enough sleep... if you get sick then things will get harder for the both of you, especially for your family and your hubby who is away from you at the moment. keep your faith strong and keep praying... God has reasons for everything... and He knows what's best for the both of you. and do what you think will be of help for the both of you... try everything and one day... one of them will work out for the both of you. just don't forget to look aftre yourself as well... i know it's hard but you have to do it... you are the only one who can truly help yourself... jsut keep your faith high... my prayers are with you...
