Hi,

Just a quick question concerning the filing fee's concerning the adjustment of status.

To cut a long story short I have arrived into the USA and married my USA partner. We are filling in the Adjustment of status forms and want to double check we are paying the correct amount.

The filing fee for I-485 with the biometic appears to come to $1,070 and the I-I30 is $420 but it is my understanding that I will be fileing both these forms together.

Do we need to write cheques for them both together? Seperately? Or do we just need to pay $1,070 as all the forms will be posted together?

According to this page you don't need to file I-130 if you were fiancee and just got married. I may be wrong so I will follow this post, because I'm soon to go through the same procedure.

04-22-2013 - Tania got B1/B2 to visit me in States while waiting for approval.

05-06-2013 - JFK POE. B2 approved for 6 months stay.

05-28-2013 - text from USCIS status changed to "Post Decision Activity". I-129F approved and NOA2 mailed.

06-01-2013 - NOA2 hardcopy

06-27-2013 - Email with instructuions from Consulate received

09-11-2013 - Interview

10-04-2013 - POE JFK

11-20-2013 - got married.

12-06-2013 - express mailed I-485 to Chicago.

12-09-2013 - I-485 delivered to USCIS Express, proof of delivery

12-13-2013 - USCIS Chicago payment cashed.

12-13-2013 - email/text I-485 NOA1
12-17-2013 - I-485 NOA1 hardcopy

01-14-2014 - biometrics scheduled.

Appologies if I wasn't clear.

My Fiance (usa citizen) is filling in the I-130.

Myself (England born) currently living in New York, USA (formally England). I have arrived on K1 visa and we are now married.

I am filling the I-485 in order to get a Green Card so that I can work.

I am getting my way through the I-485 and believe she needs to fill in the I-130 which I will include with my I-485 which when complete will be sent to USCIS in Chiago.

What I am wondering is the business with the fees.

The I-485 with Biometrics appears to be costing us $1070. There is a filing fee of $420 I believe for the I-130 but both forms will be together and I suppose I am wondering the following:

Do we need to pay for both filing fees? Or does the $1070 cover the other as they will be posted together?

If we do need to pay for them both do we pay them seperately?

Okay, so if you arrived on a K-1 visa, then you do NOT need a I-130. No I-130 for you.

You will be adjusting your status based on an approved I-129F petition and subsequent marriage to the petitioner within 90 days of your arrival, which is box C on the I-485.

You will only be filing a I-485 and related forms (which are I-864, I-131, I-765) and your fee will be $1070. No more (and no I-130).

Both the I-765 and the I-131 (EAD and AP) are free to file when your include them with the I-485. The total fee is $1,070.

I think you have been reading instructions for a non-K-1 AOS process because you seem to have some things mixed up.

For a K-1 AOS the USC does not need to include passport photos. All of that info and more can be found in the form instructions at uscis.gov.

Make sure you are only taking advice about AOS from K-1.

aha ! A K-1 visa-based-adjustment of status.

Cool !

So, if you two were married within 90 days of hitting USA dirt, you not need to include the I-130 at all. If you were married AFTER the expiration of yer I-94 document, then you must to include the I-130 petition, as you failed to abide by the rules of that K-1 visa (marry within 90 days) and must to seek a new status.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
