Hello All

Does anyone know if a petitioner who is a U.S citizen has to provide her/his copies of recent income tax reports when filing I-130 and I-485 for a beneficiary spouse? And, if yes, for how many years? I checked forms’ instructions and didn’t find this mentioned anywhere. One paralegal told me that one year income tax from petitioner is enough. But I want to know for sure.

We do have a sponsor who will present his last 3 years of income tax, pay stabs etc.. along with signed I-864.

Can anyone please comment?

Yes, please read the I-864 instructions. The petitioner, even if they do not qualify as a sponsor, must submit a complete I-864 (which includes tax returns).

Thanks for your quick response Harpa! I just found it in i-864 instrustions.

It says the follwoing:

You must provide either an IRS transcript or a photocopy from your own records of your Federal individual income
tax return for the most recent tax year. If you believe additional returns may help you to establish your ability to
maintain sufficient income, you may submit transcripts or photocopies of your Federal individual income tax returns
for the three most recent years.

Basicly says "the more the better". For my wife the requested the last three years at the time. Eventhough this is written nowehere, this is what they asked for. If you have a CO who goes by the book, they will only ask for a year, but never count on anything with USCIS.

It's amazing how many questions can be resolved with a 2 minute Google search...

Moved from Bringing Family Members of US Citizens to America forum to Adjustment of Status from Work, Student, & Tourist Visas forum; concurrent filing of an I-130 and I-485 starts the AOS process from one of the previously mentioned visa types.

June 17, 2010: Arrived for second in-person meeting and start of travel together to other areas of China!

September 1, 2010: Switched course from K1 to CR-1
December 8, 2010: Wedding date set; it will be on February 18, 2011!
February 9, 2011: Depart for China
February 11, 2011: Registered for marriage in Wuhan, officially married!!!
February 18, 2011: Wedding ceremony in Shiyan!!!
April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)

November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

NO. Absolutely NOT.

You file the tax returns with the I-864. When filing an I-130 you would wait until the I-130 is approved and then you will be asked to submit the I-864. When filing the I-485 you would file an I-864 simulaneously and attach your tax return. If you are filing BOTH an I-130 and I-485 together then you file the I-864 also. The tax return is associated with the I-864, not the I-130 or I-485. It may be nit-picking bu tI read carefully and interpret literally. You did not state the proceedure you are requesting so I answer particular to the documents you requested about.

One year tax return is sufficient. The I-864 asks for copies of ONE year tax return (most recent) and for a statement of the gross income for three years. There is no penalty (and no particular benefit) for sending more information than asked.

He has not asked anything about a consulate interview. Ukraine does not require more than 1 year. I suspect he is not asking anything realted to a consulate interview given the forms he is asking about.

My guess is that this is a K-1 which did not marry within 90 days OR a person adjusting from some visa other than a K-1. There will probably be no consulate involved.

My guess is that this is a K-1 which did not marry within 90 days OR a person adjusting from some visa other than a K-1. There will probably be no consulate involved.

I live in U.S. and lost my status due to a moron attorney who screwed up my case. Now, I got married to a US citizen and we’ll be filing the paper work soon.

My wife actually doesn’t have her recent year of income tax. So, is it an option to wait till next year when we file our 2013 income tax together as “married jointly” and send this copy along with other documentation?

Please advise.

Why would you do such a thing? Your wife can file her old taxes now if she forgot to file.

Why would you do such a thing? Your wife can file her old taxes now if she forgot to file.

We'll try to do it but it may not be possible in her case. So, is filing taxes together next year and submitting recent (2013) report a good alternative option? What do you think?

Why wouldn't it possible? It sounds like a lot of silly excuses, to me.
