just a question ,i received a need for a joint sponsor because my husband does not meet the income requirement of the poverty line ,but we can`t find one .So is there any way to get around it since he is a US citizen? Should i get a lawyer ?

would getting one help ?and will my case be denied ?

all info will be appreciated.

Can he find anyone to help such as a parent or any other family member? It can even be a friend who is nice enough to help you guys out.

I am not sure what happens if you can't get one but good luck!

sadly no ,his aunt at first promise to help ,bragged about her six figured income but when push came to shove ,she said she didn`t want to be responsible for me for a period of ten years .i guess i wasn`t family enough for her.

Answering your questions:

4. if you go ahead and try to get the visa, you'll probably be denied at the interview.

Some ideas that might help:

1. a joint sponsor just has to cover the "rest" of the amount required. This joint sponsor doesn't need to earn more than the requirements.

2. if you have any money you can send to your fiance, he can use that as assets. The minimum for assets is 5 times the required for the income.

That does not appear to be true according to the I-864......(since this is in the AOS forum I assume the OP is wanting AOS info but I think this applies to I-134 too since I've never heard of covering the "rest" of the amount)

Here is what the I-864 says -

If your income alone is not sufficient to meet the requirement for your household size, the intending immigrant will be ineligible for an immigrant visa or adjustment of status, unless the requirement can be met using any combination of the following:

-Income from the intending immigrant, if that income will continue from the same source after immigration, and if the intending immigrant is currently living in your residence.

-If the intending immigrant is your spouse, his or her income can be counted regardless of current residence, but it must continue from the same source after he or she becomes a lawful permanent resident.

-Income from any relatives or dependents living in your household or dependents listed on your most recent Federal tax return who signed a Form I-864A;

-A joint sponsor whose income and/or assets equal at least 125 percent of the Poverty Guidelines. See question below for more information on joint sponsors.

It also says this -

A joint sponsor must be able to meet the income requirements for all the persons he or she is sponsoring without combining resources with the petitioning sponsor or a second joint sponsor.

As JamesMiranda points out, a Joint Sponsor has to be able to cover the full amount on their own (or with their own Household).

For sponsoring a spouse or minor child the asset to income ratio is 3 to 1. And the sponsored alien does not have to turn their assets over to the Sponsor in order for them to be counted.

What I-864 says does not necessarily apply to non-immigrant cases, unless a consular officer decides to apply it in the exercise of their discretion (the requirements for a non-immigrant visa are quite subjective).

She can't sponsor herself, but her income, if any, can be included with his since she's a Household Member. In which case her income does not need to be 125% of the poverty leve, their combined incomes do.
