Actually, this is subtly, but critically, different from the actual argument against gun control. The real argument is that if something is already illegal but people are doing it anyways, making another law that makes it illegal doesn't actually do anything.

In many jusrisdictions and venues, it is not illegal to sell a firearm to an in-state buyer without the buyer having to pass a background check. Thus there is no way for the seller to know whether the buyer is eligible or not - as long as the buyer is not from out-of-state, the seller is allowed to proceed with the transaction. Sure, one is not supposed to sell to an ineligible person but one cannot really determine who is and who isn't eligible if no background check requirement exists.

It was also not illegal to sell that firearm - the murder weapon used in the mass murder on Monday - to one Aaron Alexis the weekend before. That transaction was perfectly legal under the law. I don't think it should have been. In order for it not to be legal under the law, the law would require changes.

That's what the effort is about. And it is constantly met with the strawman argument that the laws are just fine if only they were enforced. Nonsense.

I'm still not convinced it was legal under Federal law.

Seeing that 12 people are dead as a result of that transaction, I am certain the dealer would have been picked up by now if he could be charged with anything. Instead, the dealer continues to sell firearms to out-of-state buyers. It's lawful alright. But it's insane at the same time.
