Tracking Recently Approved I130 Petitions

Sorry, somehow I missed that part of your post! If your I130 NOA2 does not specifically say that the petition is being retained, then it really shouldn't be retained if the USCIS follows its own policy. So no need to file an I824. Just call the NVC to see if they have received it. Good luck!

I suppose then from your reply that I souldn't send the I824.....right?

FYI, I called the NVC today to get my case number for my K3 and they don't have a record of the approved I-130 so I'm assuming it was automatically retained.

Did you receive the NOA2 in the mail yet? If not I wouldn't assume it's been retained yet...it normally takes about 2 weeks, and can take more than a month, for the NVC to receive the approved petition.

My husband just got both NOA2s today (for I-130 and I-129F). They were both approved on the same day (January 9). NVC received my I-129F on January 11 and it was shipped out to their mailroom on January 12. NVC doesn't have record of the I-130 yet... I'll post back tomorrow what the NOA2 for the I-130 says when I get it tomorrow. He's coming up for a visit.

Congrats on the approval -- I could add you to the list, but the idea was really to observe the effect of the new policy when both an I130 and I129F were filed. But truly congratulations!!

Thanks Riblet. He just left...

Anyhoo, he brought the I-130 approval and says that I indicated that I am in the U.S., blah blah blah. Not true. The I-130 application we filed, we left question 22 completely blank (didn't write "none" or "n/a", just blank) since I am not in the U.S. and we did not write down any consulate on the form (I just double-checked our copy again).

Looks like they are retaining the I-130 if you file an I-129 regardless of what you write down for question 22.

So you can also update my status to "retain".

From the pattern I've seen, it doesn't seem to matter what you answer to Question 22...although if I was applying now I would answer "I am NOT going to adjust status, and I want an IR/CR1 visa through the consulate in Montreal"

The key seems to be whether there is an approved K3 - which makes sense - otherwise I'd have a retained I130 and no K3 either, and I would not be happy!
