Well, weed is used for recreational purposes use in Colorado and Washington State legally now. I do not understand what weed has to do with visa. You should ask if there is more resons than that.

Today my fiance had his interview with the Kingston embassy. I have yet to actually hear from him as he left his phone with someone in a town close by since it's not allowed inside the embassy. I knew he should be finishing up so I checked visa status and and it says refused. I called DOS and due to the fact the embassy has finalized the process, they were unable to tell me the reason is. I am going crazy over here as I've seen so many get approved every day. What do we do next?

I'm so sorry to hear this. If he admitted his drug use then I'm sure he was just doing what he thought was the right thing by "fessing up". This is terrible but at least it's only a year ban. I know that seems like a lot , trust me I've been away from my fiancee now since June and that seems like an eternity but I have to keep reminding myself that there are people who have to deal with a ten year ban and some who have permanent reasons they can't be together so be thankful. With that said I know this SUCKS majorly. We put a lot of time, money, effort, stress and more into this process so for him to be denied for a little weed is heartbreaking. All I can say is, plan lots of trips to see him, skype, call, do the best you can and a year will fly by. Sorry again and best of luck to you.

Sept 7th, 2013 = K1 Visa Application Submitted

Sept 18th, 2013 = NOA 1 via e-mail - Case Accepted and Routed to Texas Service Center

Sept 27th 2013= Received NOA1 hard copy

Oct 5th-12th 2013 = Had an AMAZING week together and now back to waiting...ClockWatch2.gif

February 12th 2014 = Five month mark passed. Service request ordered. They said in 27days we should have an answer.

March 15th 2014 = ALIEN REGISTRATION NUMBER CHANGED! FINALLY! dancin5hr.gif

May 31st-June 11th 2014 -Spent a Beautiful week and a half together and got a huge surprise on the day before she left. :D

June 10th 2014 = PETITION APPROVED!!! Hallelujah! :dance:

August 8th 2014 = Medical. Results: Passed

September 23rd 2014= INTERVIEW: APPROVED! so happy!!!!!!!

September 25-28th 2014 = System Error prevents VISA from being issued. :cry:

September 29th 2014= VISA in hand :dancing:

September30th 2014= Entered the USA :thumbs:
December 22nd 2014=MARRIED :)

March 18th 2015 = Filed AOS

April 3rd 2015 = Received NOA1 hard copies

June 20th 2015 = Received EAD/AP card in mail :)

July 28th 2015 = Received Notice of Potential Interview waiver :mellow:

Feb 29th 2016= FINALLY! RECEIVED MY GREENCARD! :dancing:

Sorry to hear about denial. The non-impediment is on the letter in your packet 3, also we had a discussion about it. I am not sure how you missed it.

Sigh, I know that you are upset, but degrading others does not help. Your fiance has a criminal record. Marijuana is illegal in JA. Also, admitted drug use. The one year ban is a year. There is no breaking it up. The one year starts now. Your fiance has to prove he is drug free, by going into rehab and/ or frequent clean drug test results over the one year period. Be thankful, it used to be three years. You can then reapply.

Turns out it isn't a ban. I spoke with DOS yesterday and she said that at this time he is ineligible until Aug 2014 due to the medical report. She said she doesn't have an explanation as to what the medical issue is but just that he cannot reapply for a K1 until that time. She did say we could get married and apply for a CR1 and explained that whatever the problem with the medical is must be gone. Due to the fact that the consular explained how he explained it stands to reason that my fiance either told the Dr the truth, then told the consular the truth, his refusal was imminent. The consular told him one year but the one year mark would be up sooner than Aug 2014. But, honestly I am thankful it isn't a ban and that we can just go ahead and file a CR1 sometime around the beginning of the year. I am going there next month to marry him. And to those all wondering.....yes, he will remain drug free. He is feeling really bad right now because he knows this is all his fault. We will get through this. Thanks to all of you who posted kind words and thoughts regarding my situation. Also to those with good advice. I won't likely be checking back on this post anymore. It's now water under the bridge. I do not want to harp over what we cannot change. Moving forward.........

Thank you. I was just thinking after my last post and remembered a comment someone said about him having a police record. Actually that was another thing he was honest about. His police record is clean. He was arrested but never charged for the two arrests. The embassy, nor the the consular would have known of the arrests, had he not disclosed them.

Sounds like as pinkrlion said, he failed his drug test . Probably will take a year to get an interview again if you get married. Better to make sure this time that he can pass the drug test or he'll be in the same boat .

This is not directed at the OP as her fiance did the right thing by admitting to the arrests. Don't think for a minute though that the feds can't see your arest record even if you were never formally charged or convicted. Plenty of police agencies abroad keep and report thi info. It is best just to be honest about whatever is in your past.

The same is true of all felony arrests, misdemeanor arrests for state laws, and some federal misdemeanor arrests in the US.

Update! Found out from DOS that getting married would be silly as our K1 wasn't closed. There was only the ban (ineligibility). Come this Aug 1 he is eligible again. All he needs to provide is another police cert, non impediment, DS 230, and medical. He hasn't smoked, nor been arrested for anything. The problem now is the embassy isn't giving me answers to the process once we get to Aug. I've emailed them and asked if he will need documentation from them to get the medical appt and if he will have another interview or just bring the updated documents? Does anyone know how the process works? I don't want to know someone's best guess, please inform if you've been through this personally or know of someone who has. Thank you
