Hi!

My name is marta. Please I need help, I don't know what to apply for.

here's my case:

I entered USA at F-1 student visa. I got married in Chicago. I dont know if I should file with my husband for K3 (but I am in US) or just to apply for Adjustment of Status? Please help!

You would need to file for adjustment of status I-485 and your husband needs to file for you the Petition for Alien Relative I-130. There are some other forms that are required by these two that also need to be filed as well such as Bigraphic information (for both you and your husband), Medical Examination form (I-693 and I-693 A for vaccination), in addition, your husband needs to file Affidavit of Support I-864 and if you want Employment Authorizaton Document I-765 if you want to work before you get your green card.

Thats what I thought. I am just wondering if I still have to leave the country ( because of I-130) I am enroled as a full time student at the University on my student visa.

It might be worth a brief consultation with an immigration attorney, as you don't provide a very full picture of exactly what happened and there can be complications that we don't know about. I'm also not sure about the ramifications on your student visa, as in whether or not you can continue to study.

But if you entered with intent to be a student, not to marry and stay, you will probably be fine to Adjust Status. AOS is the only method by which you can stay in the U.S. without having to be processed elsewhere.

Definitely read the guide on Adjustment of Status, it is very helpful :) Good luck, and congratulations on your marriage.

I also entered the U.S. on an student F1 visa and am in the process of filing for Adjustment of Status. I briefly talked to an attorney (it was a free consultation) and he said that as long as I am NOT out of status (enrolled full time in college) then I would not have to leave the country. So if you are in status (full time student) when you file for adjustment of status, then you do not have to leave the country.

Did your husband file a I-130 petition for you as well or jou just filed for an Adjustment of Status?

Actually I am the husband. We have not filed our papers yet, we are still waiting on the transcript of tax receipt for the IRS before we file. but we will be filing the I-130 petition and the adjustment of status.

The I-130 is filled for your husband saying that you are married to him and he wants to give you a green card.

the I-485 (adjustment of status) is filed by YOU saying you want to change your immigration status from F1 to "Permanent resident"

you can file all these forms at the same time.

How do i determine that i, cessna_inspiron, isn't out of status? I have been living in the USA on tourist visa for 7 months and overstayed.

you have over stayed your visa. That is the definition of out of status.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.
