My wife and I are looking to file for adjustment of status based on Marriage. We submitted form 4506t to the IRS to request a transcript of her tax returns and we sent this in on November 17th (3 weeks ago) and we still have not received the Transcript yet, the joint sponsor also submitted the same form to the IRS last week and still has not received their Transcript. I thought I read somewhere that it takes up to 10 days to get the transcript back for the IRS and 21 days is way past that. I am hoping it gets in soon, but since we are almost half way through the month of december, we were thinking of actually submitting out Adjustment of Status in January of 2007 vs submitting it this month. the reason for this that in January there is a free immigration clinic in town that would help us file the paperwork.

my question is the following: if we end up filing for AOS in January, this would put us in a new tax year, but the W2 forms usually do not get in till the end of january, so would we still submit the tax return transcript for 2005 or would we have to wait on us receiving the W2 forms for 2006 and submit those?

Submit what you have, at the time you submit.

If they require more doc's, they will notify you (subsequent year's tax records).

Marriage is based on date of marriage, not on date you receive tax documents from your employer.

Submit what you have, at the time you submit.

I don't think you need coies from the IRS. You should be able to use copies of your duplicates you kept

They won't expect you to send in a tax transcript from 2006 in January seeing as 2006 taxes don't need to be filed until April. So I think in that regards, there would be no issue.
