Hello everybody. Im a new member. I just want your opinion about my case. We already have our I-129f packet assembled. We are ready to send it to USCIS but we're just wondering if we are making the right choice as my fiancee has been living together with me for 10 months now and he wants to stay until the visa process is completed and I am granted my visa to go to U.S.A. He have a U.S based address and bank account, driver's license, etc. So I assumed he has established domicile requirements. Do you think there would be any problem with that? And if so, what about getting married here and getting the K3 Spousal Visa? Any feedback about this, would be much appreciated.

k1's are processing relatively quickly right now

130's are running up to a year for approvals, but will improve quickly next month with the new facility

Thanks for that info, Stevie. Since our papers already set up for K1, maybe we should just follow it. Just wondering because most of the cases seem to be leaning towards the Petitioner that has already returned to his own country while the visa is still being processed.

they could go to the moon and uscis wouldn't care

you filed already?? stick with it.. approvals for 129's are like an avalanche right now.. they just keep coming

K3 is no longer valid for most countries.

Its either K1 or CR1.

Once you have filed for the K1, i would process it... go through with it. Go to the states and

get married and go through the process. I can understand that people change their minds

but the process to cancel one petition, to start another one would be complicated and time

consuming. Good Luck..

Sorry I mesread your post, you can get married in the phils, then process your I-130

but I believe that the process takes more time...do some research on it

i-129f process = faster processing however a lot expensive than i-130

i-129f process = faster processing however a little expensive than i-130 since you still need to undergo AOS

You may also want to check regarding Direct Consular Processing since you and your fiance are both in the Philippines.

K3 is sort of a dead visa, they are converted to CR-1

I think being your fiance is there in the Phils with you that you should get married there and file DCF (Direct Consulate Filing) for the CR-1. MUCH faster!! :thumbs: Especially being that your fiance wants to stay there during the process.

Is your fiance legally living with you in the Philippines? If so then get married and do DCF with the US Embassy Manila. :D Fastest route.
