My case is taking to long... and I never recieved the RFE they requested what do i do

Hello everyone

My name is Sandy. I filed my petition on the 5th of February and they received it on the 12 of February. I only received 4 letters so far.

The first was a receipt on a form I-797C, Notice of action that stated they received my petition.

I waited for a couple of months and then called to ask about my petition and they said it was still being processed and I had to wait. that was on April/17/2013. Then I received a letter from the U.S. Citizenship and Immigration Services that I had called about my case.

The next letter I received was on June 21,2013 it was a transfer notice on the form I-797C, Notice of action that stated they had transferred my case from Vermont Service Center to the Texas Service Center in Mesquite, Texas. It only stated that it was transferred because they had jurisdiction over my case.

The final letter I have received was on September 5, 2013 in a receipt on a form I-797C, Notice of action that stated they received my 340.00.

During all this time I had gone to the USCIS site and entered my file number and it always said it was in the initial review. Then in June it said on the website they sent a request for evidence. So I called the 1800 number on Aug 23, 2013 and told them I never received the letter, and they said they would send another one out between 30 days. Its almost close to the 30 day mark and still no letter. I did however receive a letter but it was a letter stating they received my payment of 340.00. Now I sent that a long time ago with my petition back in February 5,2013. I'm worried my time is going to be up and they will either delay my case or place it as abandoned. I have called again to the office and they said all I can do is wait. The problem is that its been almost 7 months now and I never got a letter of RFE and I am afraid the time that it said online and now will cause it to be abandoned, and that would mean I have to start all over again. Does anyone know what I should do or if they have heard anything about this in their case? Any help would be appreciated.

absolutely call them to ensure they know you do not have the letter yet. you know they are time sensitive, usually 60 days

call call call until you get it

each time they are forced to send a new one, the 60 day thingy restarts, although I know that is not the optimal solution

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Call your local congressman. Sometimes when they get involved it seems things get done faster. I think that your file was lost or something. Did you check to see if the check went through in february or later when you got that letter?

Yes, definitely better to ask help of your local representatives. We were also February filers that waited 5 months to get congressperson's involvement. When a liaison sent inquiry to California Center, our petition was approved in 2 days.

Did you read other posts about no RFE hardcopy reaching despite of what the center says?

I am sorry about your troubles but it seems action is the only way to move the situation.
