Consul asked for meet in person proves

Hi Everyone,

When we filled the I-129f, USCIS asked for proves for 2 year meeting in person, we sent a hardship to waive that requirement as we did not meet personally for many reasons that we provided to them with supported documents and proves, USCIS approved it and the case was sent to the embassy in Jordan, Now my fiance when he went to his interview, the consul asked him for a prove of meeting in person again! Does that mean we have to meet again now? or do we submit the hardship letter to the embassy? Can someone help please ?

you will find few to none in terms of folks here who have been successful at obtaining this waiver

absolutely make sure the embassy has a copy of the letter

the beneficiary should be able to speak to the waiver and the reasoning without pauses or thinking

other than that I have no idea about the meeting now since you already got past uscis

her fiance was denied at the interview for an overstay and was told to submit a waiver for that as well.

I am not sure if Jordan is just the same procedures in Philippine Embassy . One proof for fiancé is the Photo showing that you meet each other in person and your family as well... Photo which is labeled if its family gatherings then you labeled it with family gatherings with so and so , location, time and date. Photo will be bring during the interview. another proof that you can attached in the form I-129F is the plane ticket that you are together, boarding pass , hotel bills or resort. for the on going relationship proof.. you need to attached in form I-129F phone calls circle his/her phone number, money transferred, if he/she send some financial support, copies some of the internet conversations, engagement ring. that kind of proof they need..

USCIS will approved but when it comes consulate general ( Interviewer) they needs those Photo showing that you really meet each other in person and meet your family as well... and those proof that I mentioned in your form I-i129F. I am sure the consulate General or the interviewer read your waiver and they are the one who will decide if waiver is acceptable or not...

So, the CO found him inadmissible and said he was eligible for a waiver, which is info you left out of this post. That was the end result of his interview, yes? Are you saying the CO is still insisting on you providing proof of meeting now, after the fact? Or was that just a question the CO asked during the interview? Was he given a paper asking for additional evidence? It seems as though the CO made a decision already, which was a denial due to the overstay and him being inadmissible due to his ban. Not sure why the CO would need additional evidence from you at this stage.

Hi, yes, he gave him a letter requesting to prove the meeting within 2 years, divorce certificate and civil certification and also a letter to submit a waiver for his inadmissible where he is baned til june of 2016 , i am not sure if that means we have to prove meeting from when we first met or at the current time. He told him to bring pictures to prove engagement and that we met in person, but on the paper it say prove of meeting in person. He told him to submit the info requested and then they will call him back to reschedule his interview ,

Hi and thanks for your reply, we submitted a hardship to waive the requirement to USCIS and they approve it, but the CO asked for proves again, USCIS told me that the embassy can ask for anything they want , so what ever was approved here the embassy can ask for it again. The CO told my fiance to get the requested info and they will call him for another interview. hope that work out!

Okay, so it seems that even if your hardship waiver gets approved for the overstay ban, then he would still not get his visa unless you provide the evidence asked for to satisfy the CO. Since you did not meet within those 2 years before filing, there is nothing else you can provide other than proof of when you did meet(which was outside the 2 year requirement) and the hardship waiver you sent that the USCIS approved. I suggest you speak with an immigration attorney.

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

The Consulate are requiring proof that you have met within 2 years.

USCIS was a different agency/issue.

To file a waiver for the overstay he first needs an otherwise approvable petition.

It does not really make sense to bring in a Lawyer half way through, it does not save you much if anything on fees and may actually complicate matters.
